Here is where you stated that: when you repeated his mention of "freedom of speech", since the only time "freedom of speech" comes into play is when the government takes adverse action or otherwise constrains speech. The worst instance are content-based, but there are also place and time restrictions, which get more leeway.
It's a term of art. You can't not refer to that when you say "freedom of speech" anymore than someone could not refer to black holes warping spacetime severely when they say "event horizon". It means something, whether or not you like it, and whether or not you only wanted to aim a *gotcha* at a liberal.
