The 2nd Amendment is being used as a boogieman and it's been around since the Bill of Rights, but the language talks about a 'well regulated militia' and really until 2008, the 2nd Amendment was all about states rights and the right to form their own militias. It wasn't about all individuals to own a handgun. But in a 4-5 decision in 2008, Justice Scalia said the 2nd Amendment gives an individual a right but the most important thing is that even Justice Scalia said it's a very limited right and the government can regulate it just as it can regulate all sorts of rights. Justice Scalia's decision said you can have background checks, you can prevent the mentally ill from getting guns, you can prevent felons from getting guns, you can prevent domestic abusers from getting guns. Also he said the type of guns can be restricted. So he said the 2nd Amendment was about the guns "that were in common use at the time"-- that was his language. What was in common use at the time? Things like muskets and the like, not grenade launchers and assault weapons and high capacity cartridges and all the stuff that's creating mayhem and murder today.

Democrats are saying "look, I believe in the 2nd Amendment. I believe that an individual can have the right to have a gun. But that doesn't mean anyone can have a gun that can produce mass murder and carnage and it doesn't mean that any individual such as someone that's mentally unstable should have a gun, nor should anyone that's underage." There's reasonable restrictions that can be imposed totally consistent with the 2nd Amendment which is only being used as a tool to stop sensible gun reform. The results are in the streets and they're devastating. This country has to do something about it and it's sickening how Republicans keep hiding behind the 2nd Amendment.
