No federal charges for New York policeman in 2014 'I can't breathe' death

Let us not forget that there was no physical damage to Garner resulting from a chokehold and that he died of a heart attack an hour later. His death was ultimately the result of obesity related health problems and there was never a good reason to criminally charge the officer.

Let's not forget that Garner lost consciousness while 5 people were on top of him and one used an illegal chokehold and how stressful situations can trigger heart attacks.to people who have already health issues.
 
Being defiant toward a police officer is always a behavior that is going to result in some kind of unpleasant consequence.

Then like I said, don’t put yourself in those situations if your heart is a ticking time bomb because of your obesity.
 
Let’s not forget the ME’s details though regarding his obesity related health conditions. Or that his daughter died exactly the same way at the age of 27 sans chokehold. I don’t think it’s unreasonable for the ME to have concluded that the stress of the situation triggered Garner’s poor health in a chain of events that resulted in his death and therefore ruled it a homicide. However, Garner is ultimately responsible for his state of health and for creating that situation by resisting arrest.

The ME was crystal clear that he had obesity issues. But the ME also testified under oath that his death was caused by the chokehold.

Contribution to his death by unnecessary use of force should be enough to press charges against a police officer and have a jury hear the facts and make a decision.

I disagree and all of this has already been heard by a grand jury. They did not hand down an indictment.
 
Yes, with those health issues being contributing factors.

You're trying to make the argument that counters what the ME testified to. If the chokehold was illegal, it was illegal. It doesn't matter if Garner was fat or thin, old or young.

She said the chokehold caused his death. Everyone can say "but he was fat" or "but he was diabetic", and it still doesn't change that.

Not saying the LEO should go to jail, but it is true that the chokehold killed him, and from what was testified to, it was illegal.

And good on them. When the grand jury in New York refused to indict that should have been the end of it. Trying to get him in another forum is just malicious and there’s no reason to believe it would produce a different result.

Nope!

The grand jury hears only the things that the local prosecutor tells them. And these local prosecutors are the same ones who collaborate with the police there. There is a serious conflict of interest in this design.

The State's Attorney General, Civil Division wanted to proceed with prosecution of the cop. WILLIAM BARR made the deciding decision NOT to prosecute. That's not a surprise to anyone, is it?

The State’s AG was told by the people of New York serving on the grand jury in 2014 that this doesn’t rise to the level of criminal indictment. Nothing has changed in the way of the facts of this case so, no, I’m not surprised that the Federal government refused to disregard the people’s decision on this matter to score brownie points for the State AG.
 
At the end of the day the police killed someone over untaxed cigarettes... let that sink in apologists.

Your are in danger with any encounter with the police no matter the reason, and you can be killed for almost nothing.

No. At the end of the day, Eric Garner put his life on the line over untaxed cigarettes and died ultimately because of his obesity. Resisting arrest is never a good idea and particularly if you’re in poor health. But there are some thick skulls who will never let that sink in.

Do you have any evidence at all that the local prosecutor withheld evidence from the grand jury or are you just blowing smoke?

Don’t care because it’s moot. Our justice system is designed to moderate the whims and opinions of zealous prosecutors and AGs with the decision making authority of the people as represented by the grand jury.

So it's okay for the police to kill you with an illegal chokehold as long as you're fat.
