California Considers $1,000 Fine for Waiters Offering Unsolicited Plastic Straws

We should have the finest recycling infrastructure on the planet; tons of litter could be recycled and repurposed.

We could be defraying the expense of State government, with better recyling capability.
 
Why is levying a fee imposed on the consumer always the CA. Democrat's answer to everything? Why does banning something like a plastic straw end up costing the consumer money out of their own pocket?
Banning plastic straws will be the same as banning single use plastic bags. Stores now charge 10 cents for a reusable plastic bag because one use plastic bags have been banned in the state of CA. Who reaps the profits for the reusable bags? Environmental groups? Um, no...
Who then? The merchant! Environmental groups say this is okay though because people will reuse their bags or cutting down on the numbers of one time use plastic bags. I guess I am okay with the banning of one time use plastic bags and plastic straws if it cuts down on clogging streams and creeks, etc., but what I do object to is my having to pay more to use a reusable bag or requesting a straw.

How is a fine that they have to pay if they do it (and is capped at $300 annually) end up being a fee passed onto consumers? Are the restaurants going to lie and claim they unfairly got fined and now they are charging a penny more per drink to make up for that annual loss, despite the fact that by not providing a straw unless requested, they would be saving money anyway?

I never implied the fee they will be charging a waiter be passed onto the consumer but the article in the O/P said paper straws will cost 8 times as much as a paper straw if restaurateurs decide to offer them as a replacement for a plastic straw. So there's one way the cost will be passed onto the consumer. They'll simply add it to the cost of the products they sell.

And they likely would not need as many, whether they offer plastic or paper or other alternative straws for customers to request. No restaurant has to offer straws (sit down types). Many even here in NC have you request one, to save them money.

This bill would prohibit a food facility, full-service restaurant, as specified, where food may be consumed on the premises, from providing single-use plastic straws, as defined, to consumers unless requested by the consumer. The bill would specify that the first and 2nd violations of these provisions would result in a warning notice of violation and any subsequent violation would be an infraction punishable by a fine of $25 for each day the food facility full-service restaurant is in violation, but not to exceed an annual total of $300. The provisions would be enforced by the same officers authorized to enforce the California Retail Food Code. By creating a new crime and imposing additional enforcement duties on local health agencies, this bill would impose a state-mandated local program.

If you hadn't said the state in the title I would have likely thought this was an attempt at political satire. Considering it is California it isn't shocking in the least.

Only in CA... The lawmaker who wrote this original bill, (punishing a server) should have been recalled.

I don't see where the original bill said specifically that the server would be punished. That seems to be an assumption that was made by those reading it and disapproving of the bill.

Calderon, the Democratic majority leader in California's lower house, has introduced a bill to stop sit-down restaurants from offering customers straws with their beverages unless they specifically request one. Under Calderon's law, a waiter who serves a drink with an unrequested straw in it would face up to 6 months in jail and a fine of up to $1,000.
 
There are plenty of other alternatives to plastic straws besides paper straws.

You know what?... He's a Californian like me. I'm gonna' assume he loves this state like I do, but we don't want to be forced out of here by nanny do gooder type legislators imposing more in the way of over-regulating and higher taxes.
