Switch things around a bit and see how it sounds: A woman meets what she thinks is a lesbian with a strap-on who turns out to be man and, thinking that it's woman with a strap-on, they have blindfolded sex, . I think we're underestimating the depth of deception at play here. This sounds like 12 years of fraud, where that fraud was leveraged for sex.

What i find most unusual about this case is whether or not it's a crime to lie to someone for the purpose of obtaining consent. I'm inclined to think it should be because a 12 year intimate, online relationship can build a lot of trust.

This essentially the exact same situation as when a transgendered man/woman deceive a male partner. The only difference is this girl isn't trans. The punishment though is a bit harsh, more than a bit harsh to be honest. This is more of a compensate the victim case than remove perpetrator off the street thing. I do believe the victim is culpable in this case as well, for not doing a minimum of due diligence.

According to the BBC article this is the second time she's been convicted of this crime. Given that the sentence may not be harsh enough.

But the false identify resulted in her agreeing to have sex basically with the false identity, some guy. Not her friend, a girl.
She did not consent to have sex with a girl/friend, the false identify removed that option from her.

There are consequences to deceiving people into doing something they would not normally do.
If this was just some one night thing, and the girl had no history of this, and just did it because she was in love...I doubt it would have been this way, but apparently she's doing more than that.

It is strange though, I mean, at what point did it cross the line from consent to assault...was it because she was a girl and not a guy, or a friend and not a stranger?

When someone picks someone up at a bar, and the person lies about being a movie executive...and they have sex...is that non-consensual too?

What about when they lie about, say, being married?

This is a slippery slope, but i'm inclined to condemn the fraud rather than solely emphasizing the gender aspect.

The victim is not lessor or greater, but she is culpable as well. Let me be even more blunt. Sex is as intimate an act as one can get. If the woman was with a man before she would know the difference one and a dildo. I am not buying she didn't know. Maybe not at first, I might buy that. But not after multiple times. I was generous in comparing the situation to being fooled by a transgendered person. I would be more sympathetic to that victim, simply because the knowledge would be more difficult to ascertain. Strap on dildo?? Really?? She didn't know? After multiple times?? I aint buying it.

I do think the punishment as meted is harsh and more to the point, pointless. The victim should be compensated. Jail for the perpetrator is poor compensation. It is was me I would want to be compensated. Money might not make me happy but it would sure make me feel better.

Hmm, good point. While i agree that it is likely a receiver would be able to discern the difference, it isn't necessarily true, it may depend on contextual details that i don't believe we have.

To the point...why didnt the woman develop a relationship with her as a woman and have sex with her as a woman? Why did she commit the fraudulent act in order to engage in the sexual assault? The answer is because the victim would not have had any interest in her romantically as a woman.

Essentially the definition of sexual assault is unwanted contact to the breasts buttocks loins and groin. In the situation you would hypothesize about perspective would come into consideration but would probably not be considered a legal violation. In that instance there was wanted contact from one individual to another individual. The contact would be received by the individual. The difference in the case at hand of course is that the victim does not want and is not consenting to sexual contact from a woman.

It's fraud. Seems deserving of a prison sentence to me.

Sure, the victim was really dumb, but so what? A lot of financial fraud takes advantage of stupid people and that doesn't get the people committing the fraud off the hook.

Financial fraud is quite different. It's thievery on a different level.

I seriously don't see how, other than some serious embarrassment, the "victim" was harmed in any way.

Now, as somebody stated earlier in the thread, if the victim has some documented mental disorder (hard to argue she doesn't after all this) I could see where some more serious punishment is called for.

The perpetrator was absolutely wrong to do what she did. No question about it.

Because it's in the news so much recently, think of the 5 guys who watched and videoed that man drowning. No charges filed. Yes, some lawyers and such are trying to figure out how to charge them with something.

This wasn't a case of the victim being drugged. I've not read about high levels of alcohol. No pot. No force used.
The victim was absolutely fine with everything happening, including the sex, all the way up until she removed her blindfold.

Embarrassing? Sure.
Stupid? Sure.

6.5 years in prison and a record of sexual assault???

How about charging the perp with fraud? Make the penalty something with a stiff monetary fine, plus community service?
$10,000 plus 500 hours in a sexual assault crisis center?
