You are correct. However, Eric may want to throw the book at him, but actually going to trial is something the DoD will fight tooth and nail behind the scene to prevent. Of course publicly, they will be in lock-step with the Kenyan's fabulously fair AG.
If this goes to trial ...
1. It will not be a 'behind closed doors' trial. Too much public interest and too many 'dream team' wannabe, pro bono ambulance chasers wanting their '15 minutes'.
2. The guy is wrong, period. I had a SCI clearance, and I know exactly what paperwork he signed ... been there, done that myself. But, the JAG knows that the ambulance chasers will want to get every scrap of paperwork (including doodles) that has ever been written about the subject. Even if the information is redacted ... the JAG knows what the problems are. Eric, on the other hand, won't care for two reasons ... first, it's a white boy defendant and second, he cares not about national security ... just like the Kenyan.
3. The Kenyan and Eric both will have their pink slips long before this even gets to trial (assuming there is one). The new AG will let this can of worms crawl back into the pile of bovine processed oats whence it came.
My personal opinion is this ... the guy should have submitted the manuscript for DoD review. However, had he actually followed that proceedure, the book would
NEVER have been published because the DoD would
NEVER have released it for publication. The Kenyan can (and did) breech any and all security protocols, but woe unto a mere mortal who does the same.
I can't wait to read the book. The spattering of information I've seen thus far doesn't make the Kenyan muzzie look too good ... especially the fabricated story about his death. I guess this is MY moment to copy the Kenyan and say, "I don't have all the facts but ...". The Kenyan tried to make himself look like a good CINC and yet again failed. Remember the Seals that took out the Somali pirates? In an ex post facto comment, the Kenyan tried to take credit for what the Navy ship Captain did ... give the order. And even worse, the Kenyan wanted the Seals to come to the WH so he could "honor" them. They did not go because they knew that showing up was their death sentence and a death sentence for any and all of their family members.
In conclusion, my opinion about the 'threatening letter' is that is just a noise making threat (a threat is something that you might or might not do). This is a bunch of 'Kenyan' wash (was going to use the word hog, but I don't want to insult either the pigs or Harley Davidson). The noise will echo for a very short time and then go away (did I happen to mention something about bovine processed oats?).
