McConnell says Trump will sign funding bill, declare a national emergency

Sure. But, as I said he already has the funds.

Things will get interesting now. Ted Cruz was talking about using the El Chapo's seized properties as a way of funding the wall; I think that was in the neighborhood of $14 billion dollars. Where it will get more interesting though is how the continued maintenance and staffing gets funded.

Mexico has El Chapo's money...They aren't going to give one peso

After seeing the "deal" that was reached, of course I was. It was not what Trump wanted. That was obvious and many of you crowed at that fact and are still crowing about it. And he DID warn everyone that he would declare a national emergency if the border was not secured to his satisfaction. And that "deal" has nothing in it that will actually do what he wanted (quite the opposite really). And I'll bet that due to how things happened the courts are going to side with Trump on this one. Why? Because Trump is going to use this new "deal" as an example of why Congress is not fixing the problem by giving him the money required to fully enforce current law.

Can you say more about your legal background that has brought you to this conclusion?

The wall does nothing to help secure the border, in fact it makes it worse because it takes funds away that could be better spent using other tactics. There is no crisis for congress to fix, the only crisis is Trump and his followers.
 
It will be interesting to see how he justifies it. I would guess that the justification will fall under 10 USC 284 (b)7 ... but I don't think he even needs a declaration of national emergency to enact that power of the executive office.

The National Emergencies Act and the declaration of a national emergency by the President causes provisions in certain laws to become effective. For example, in one law, a national emergency removes certain abilities for landowners to file suit against eminent domain claims. Other laws, during a national emergency, allow the President to access certain funds.

So yes, there is reason for Trump to declare a national emergency.

Trump likely has to sign the bill but its a shame that he should. The bill is a joke. The democrats promising to negociate and compromise in good faith and then adds so many restrictions on areas where a wall can be built and what the money in the bill can be used for that the bill has no teeth in terms of what the President wanted. He was treated poorly by the democrats and frankly the republicans again came up short of having any guts to play hard ball with the democrats. I'm tired of weak and spineless Republicans and I can't vote for a democrat because they are so left as a party and have too many leftist positions for my liking.

trump demanded billions for "a wall." HE can't even tell you why or how the money will make any difference. He just keeps repeating it and you believe him.

What are you talking about? The sky was falling long before Trump arrived. We've got "national emergencies" going back to the Clinton Administration. Obama had thirteen, so far Trump has three. If we're talking about an actual emergency, other than 9/11 this is about the closest we've gotten (drug smuggling, human trafficking, criminal aliens, etc.).

President's have Emergency Authority. He may very well have the (narrow) legal right to do this. It's simply not "right" for him to do so
An emergency is an event that is imminent -- a dam breaking, a rogue plane heading into US territory, etc. It's unfathomable that an "emergency" means a project that will require years to construct and will be tied up in private property legal challenges. If that's an emergency, the word has no meaning.

Moreover, the action is transparent -- Congress said "no."
