Because the DA is a buffoon?

If I had to guess, the brothers' lawyer was quick to get them to plea given the open-and-shut case against the "mastermind" Smollett... but their lawyer forgot that this was Chicago and the chances that a friend of the Obamas getting a sweetheart deal with another friend of the Obamas was more likely than was an indictment.

So what are the courts supposed to do once they accept a plea deal on a case that the dumb-as-a-box-of-rocks DA then drops? Some people who should have known better just decided that it meant that the brothers hatched this cockamamie plan on their own and that Jussie was the victim.

None of the dumbies ever considered that such blatant corruption in a nationally televised case would come back to bite them.

Foxx and Smollett are about as dumb as they come.

I am giving the prosecutor the benefit of the doubt. She is rather inexperienced and had something to prove, and undoubtedly under a lot of pressure. Now the pressure is from the other side.
Moral of the story. Stick with facts, stick with the truth, obey the law.

Simple corruption. The DA decided not to press charges and those in position to change their mind didn't care.

What's suprises me is that it's still coming up, so clearly there's a bit of a disagreement amongst the empowered.

Do you mean not until after a trial about the actor? Them? Sure, if that is going to happen. Then deport them after any serving any prison or jail sentence if any. But, if non-citizenships, the conclusion is their both being deported and banned from re-entry for life. If a non-citizen, they are here only by our permission. With their behavior, I do not want them ever again to be amongst us.
