Did Trump get a "mandate" to choose SCOTUS members as GOP says?

I heard a GOPer in the hearings today basically say that Trump got a mandate to choose who he wanted to be on the SCOTUS by winning the election. My problem with that is that a mandate says you won the most votes, thus proving that a majority of our citizens wanedt Trump to choose ultra right wing justices for the court. Yet we know that Trump did not get majority of Americans to vote for him and thus for his choices. He won by getting the most votes on the electoral college, and lost the popular vote by over 3 million votes. So my question to that GOPer on the committee, where is the mandate?
 
The only mandate Trump has is probably some Russian drag queen. Not that there's anything wrong with that.
 
Anyone complaining about anything Democrats do here needs to just have the word “Garland” tattooed on their forehead.

It's in the Constitution, the only mandate that matters.
 
Why does it matter ? He appoints, Senate approves. It doesn't matter how many votes anyone got for anything except for the final Senate vote.

And, oh, by the way - Because of Surrender Monkey Harry Reid, a simple majority works twice as nice.

Who are the "ultra right wing justices" you speak of?

Well, he did get a mandate. He's the president. He won fair and square, more or less. Russian interference and hush money aside.

But Obama had a mandate and Republicans denied Obama.

So what does any of it mean anymore?
 
Well, that's usually what Presidents get to do, subject to congress actually considering and voting. Something that didn't happen with Gorusch.


And now, of course, the Democrats would be idiots not to be just as dirty as the GOP. Hell, they should probably be even dirtier. Might as well find out where the bottom is if we're going to race there. First step to recovery. Or collapse.

That you need the POTUS to nominate and a Senate majority to approve to get a new SCOTUS justice seated - just like the constitution says.

Congress decides the size of the court, so I’m picturing a hypothetical President Ocasio-Cortez with a Democratic-controlled Congress adding five extra seats so that the Ocasio-Cortez sextuplets can fill the rest of the seats. I assume that conservatives on this very message board would have no objection because, hey, appointing SCOTUS members is in the constitution as a power of the President.
 
It doesn’t matter. He’s 2 for 2. My bet is that he’ll wind up with 4...which would be awesome!

Yep, then the SCOTUS could set a precedent that whatever congress passes and the POTUS signs into law is constitutional under the federal commerce and/or taxation powers.

Then Republicans refused to take even the first steps to consider his nominee after Scalia died. He made a perfectly fine nomination yet the Supreme Court went most of the year one judge light because Republicans wouldn't honor Obama's mandate.

78,000 votes over 3 states was more than enough to win the EC but does qualify as a mandate.

Granted that was not right. If they wanted to defeat him they should have given him a hearing and then voted. He deserved that and so did Obama.
 
Since Trump hold office illegitimately, he can claim no mandate for any action as president.
