I hope conservatives fully appreciate that the next Democrat in the WH will now be free to exploit the National Emergencies Act in their own way, and in accordance with their own concerns and philosophy.

All of them have proven today that their hysterics over the boundaries of executive power and constitutionalism are simply feigned, confirmed now as nothing but political buzzwords for politics.

When McConnell said we'd live to regret removing the filibuster for executive appointments sooner than we thought, he was obviously speaking of future retaliation from his side of the aisle.

Now, Mitch might want to remember that lesson himself, as this might become a day Republicans end up regretting opening up Pandora's box, should the courts allow this tactic.

I'm still not certain Democrats will get the chance. There will be an injunction against a declaration of emergency. And there are so many extenuating factors opposed to the legitimacy of this "emergency" that it's incredibly likely that injunction will be upheld.

I'm still not certain Democrats will get the chance. There will be an injunction against a declaration of emergency. And there are so many extenuating factors opposed to the legitimacy of this "emergency" that it's incredibly likely that injunction will be upheld.

By his own public words, Trump has stated the wall is already being built.

IOW, no emergency exists.

We don't know how these wild courts will rule.

If the court does rule against the administration, it will because of their open battle with Congress being documented.

But, they've left the door open regardless. They've now made it an acceptable play to at least attempt to go around the Congress during policy disagreements, to at least see where the chips fall, and I doubt a Democrat will be as clumsy in their execution as Trump has.

As an example: A democrat could declare a nation emergency on gun violence, and not take any action banning certain firearms, but instead prohibit the selling of particular firearms.

We're back to the question:

What is more dangerous? A president who would take this kind of Constitution-snubbing move? Or that he has so many supporters who will follow him into hell even though their past protests when presidents have committed less serious power grabs show that they know how wrong the president's actions would be?

The first thing you should appreciate is that EVERY President has been free to exploit the National Emergencies Act in their own way and some of them...even Democrats...have done exactly that. Trump's actions by declaring a national emergency doesn't set any precedents.
