Indeed and while the Right knew the score with the 3 judge appeals panel, ie, it came out as most everyone left and right had called it, 2-1 for Flynn, most everyone knew the score on it going in.

The Right has also been apprised by its mass of highly financed rightwing media that the full appeals court is the likely opposite. Of the 11 active judges who will hear the case 7 are Democratic Party appointed while only 4 are Republican appointed. This is radically different from the 3 judge panel that was 2R v 1D. Hence the Right are flailing on this one as they have zero hope for it.

The word I got among lawyers is that Judge Sullivan hired Beth Wilkinson to argue the case before the full court of appeals after the 3 judge panel had shot its wad which the panel did do and is now history. Neither is this the kind of case Scotus would consider significant to put on its docket.

Flynn meanwhile is out on the Trump campaign trail where he is considered so invaluable that springing him was a highest priority of PutinTrumpBarr. It's considered Flynn's 'lock her up' at the convention and afterward tilted the three blue states. So even if the full appeals court moves fast it's still unlikely to be fast enough to decide before November. The case will end up back in Sullivan's court anyway for more processing to include Judge Sullivan ordering the gallows spruced up.
