Alan Dershowitz: If FBI Raided Hillary Clinton's Lawyer the ACLU Would Be Raising Caine.

Dershowitz has been making some flaky legal opining lately.

How ridiculous does it seem the to rest of you that some poster (from England) no less thinks they know the law better than Dershowitz. Beyond laughable.
 
I do find it "interesting" how lawyer-bashers cite lawyer's opinions when they go their way. Ditto for the whole "activist" vs "correct decision" crap with regard to appellate court decisions.




Guess what: if Cohen is charged and documents seized from his office are introduced, a judge will have to rule on it. So just wait and see. If the judge rules they can be used, that will be your in to claim that the judge was always party of the vast liberal conspiracy to *get* Trump.

He believes the power of the executive is essentially absolute and the POTUS cannot obstruct justice.

IOW, he's a loon.

Context is important.
Basically, Dershowitz argued that because the constitution gives the president the power to fire (or nominate, or pardon, or veto), a president's action in firing an executive official is immune from obstruction of justice charges although he also said Trump is not above the law.

About half made sense and the other half was Digenova style horse bleep. Trump moves 5 steps back every 5 steps forward that Mueller takes. So I don't buy the cooperating trump argument in the first place. At some point, Mueller is going to take 5 steps forward and Trump is going to take 10 steps back and it will become obvious at that point that trump was never cooperative in the first place.

I am myself a bit surprised that DOJ did not request that the Cohen material go to a judge in the first place which is the extended version of the taint team effort.

The fbi conducted this raid according to the letter of the law, I don’t think judges hand out permission to seize the personal possessions of lawyers on a daily basis.

Rosenstein signed off on this raid. The fbi Director signed off on this. I don’t think they made the decision to give the go ahead lightly.

The poster I answered said Dershowitz was a "Buttwipe" so I asked if that meant he was wrong.

Since it was a personal attack, I thought I would ask if the fact that he was a "Buttwipe" changed the facts.

Now I have other posters answering for him. I don't know why.

Over 33,000 FISA court warrants issued. You didn't care. You only cared about the one targeting Carter Page, the guy who claimed to be a representative (or facilitator?) of the Russian government.

Countless warrants in federal cases have issued. You didn't care. You only cared about the one authorizing a search of Cohen's offices.

The FBI and CIA caught bad guys. You loved that. But now, because Trump is being investigated, they are "corrupt".

The rest of the federal administrative apparatus was lambasted as "big government" with "wasteful regulations". But now, it's all supposed to be a "deep state" against Trump specifically.

On and on the list goes.





So as I ask 9/11 truthers, I now ask you: exactly what explains this? What is the motive? Why is it the motive? Who benefits? What tangible gains have they gotten?

People who don't go along with whatever Trump wants get canned. A whole bunch of the people part of the various things I mentioned are Republican. So many have been in their place for a long time, longer than under Obama. Why would the FBI throw out its collective career to *get* Trump? What boon do you suggest they hope to get by replacing Trump with Pence?

Once again trump has done it to himself.

He basically compelled a special counsel investigation when he just could not keep his mouth shut about why he fired Comey and came up with excuses some of which were Obstruction of Justice.

Then more recently he throws Cohen under the bus literally making it obvious that the only logical conclusion was that Cohen has very likely broken some laws. I kind of understand what he did with Cohen because that is classic Trump. "Going to go in this direction because the blame falls to somebody else (Cohen in this case) and I am less culpable even if only marginally so". Well it just so happens that trump has opened the door to criminal possibilities for Cohen who likely at least gets disbarred out of this. This is donald outsmarting himself again combined with the fact that Cohen is not much of an attorney.

I do not trust the system, they have already proved they will obtain a warrant on the flimsiest of "evidence". They have not revealed on what grounds a warrant was obtained and the Trump haters are like "it must be good and solid" I wonder if they have another "dossier"?

You didn't care about the legal things you claim to care about now and you don't understand them anyway. Stop pretending. It's all politics. For whatever unfortunate reason, you like Trump. So you defend Trump. People who praised the FBI, CIA, etc., suddenly attack them for purely political reasons.

They ARE corrupt in so many ways. Just not that way. Instead of focusing on abuse of civil forfeiture or the War on Drugs or reliance on garbage "forensic science" or so many other things, they focus on the Trump investigation. Ignore the real corruption, the real rot, and protect Him.

If he fires someone in order to impede an investigation into him or his allies, that's obstruction, full stop. None of Dersch's delusional fantasties can change that fact.

I agree with Mr. Dershowitz's statement that Mueller is not being partisan in his actions, but he is just "determined to get his target" and the target is on the back of Mr. Trump.

That means he presumes the target has something to be "gotten" and he has to find it or none of the costs of the investigation can be justified.

Anyone over the age of "innocence" (i.e. my definition as the age when a child is not really cognizant of good or bad, right or wrong), accumulates some level of "wrongs" in their lifetimes; the older they get, the more skeletons in the closet.

IMO that's why we expect anyone facing such depths of scrutiny to be revealed as somehow "bad" eventually, and pushing for this scrutiny creates a self-fulfilling prophecy.

I also agree that instead of the FBI being allowed absolute access to ALL Cohen's files, that a Judge be appointed to determine which, if any of the files, applies to a criminal investigation and rules it accessible to the investigators.


The problem with this whole post is that if the GOP had the goods on Hillary they would have done just what Mueller has done to Cohen, raided her house and offices and everywhere else. After thirty years of trying they have never found anything to enable them to do so. You can keep on speculating all you want, but the truth is there is nothing to find. Get over it,
