5 Men Could Overturn Legal Abortion In America

https://www.huffingtonpost.com/entry/5-men-supreme-court-abortion_us_5b44c558e4b0c523e2632f62

Brett Kavanaugh’s confirmation to the Supreme Court would present an immediate threat to Roe v. Wade.

Within a few years, five men could revoke a woman’s right to have an abortion in the United States.

President Donald Trump’s nomination of Judge Brett Kavanaugh to the Supreme Court is a clear threat to Roe v. Wade, the court’s landmark 1973 decision that essentially legalized abortion throughout the country. If confirmed, Kavanaugh would likely provide the fifth vote to overturn Roe ― a ruling that his predecessor Justice Anthony Kennedy protected as the court’s swing vote on abortion.

Yup. A for-real 5 man death panel, Republican style.
Huffpo is full of crap. First off, if Roe v. Wade WERE overturned, it could still be authorized in individual states. Second with 45 years of precedence behind it it's unlikely SCOTUS would overturn it without a humongously, supremely argued case. Oh, and that assumes the court would even agree to hear the case. The justices don't just sit around deciding what past decisions to overrule.

I don't think he will. He stated is affirmation of tradition and long settled law, of which R v W most certainly is.

We shall see.
I worry more about Martian invasion than I do about SCOTUS overruling RvW.

So . . . based on your suppositions and assumptions by association, and not by anything in her actual record or work product

Until we actually have something based on her record or work, that is all we have to go by. Do you have any evidence to te contrary?

Newsflash: Black women fought for the right to choose, too.

News flash, not all black women think the same. I know several black women that are pro life, in fact the majority of women that I know of all races are prolife.

Good for you. But you're anecdotal evidence has little bearing on reality.

Abood was settled law until two weeks ago. So were Quill Corp and National Bellas Hess. With the Supreme Court things are settled law until they aren't. And Kavanaugh's answers from his D.C. Circuit hearing mean even less than his Supreme Court hearings will since the unlike the Supreme Court, the D.C. Circuit has absolutely no authority to overturn SCOTUS precedent.

Honestly I think people tend to overrate the stare decisis factor. The Supreme Court cases where stare decisis controls but there aren't 5 justices who would have found that result had there been no precedent are fewer than I think are often given credit.

Except for the fact that there are Prolife black women, which was my point. I never said all black women or even a substantial portion of black women are prolife. My question was for him to use his mind reading capabilities to teach me the motive of any black women that are Prolife if the obvious motive of those that are prolife are built on racism and misogyny.

What premise will they use to overturn RvW?

Is it? I thought I saw it on Netflix.

I just binge watched it over the holiday weekend. So depressing...but fascinating to see the society in the book expanded.

You're fear-mongering.

True, but that was Gorsuch, Kavanaugh went out of his way to state his affirmation of "tradition" and "settled law".

But, like i said, we shall see. You're taking Schumer's view, which is noteworthy, as well. You might be right, but Kavanaugh is likely to pass the senate.

I'm tired of men who believe that life begins at erection. That women will be used as "handmaids" to produce white babies to prevent brown and black people from outnumbering whites is obvious.

I don't even know where to go with that.

Really?

Do you actually believe that and, if so, where did you get that idea? I mean, I've seen some off the wall stuff this past year or so but .... DAMN!!

Wow. Talk about racism on full display. You do know that black women are 5 times more likely to have an abortion than white women? Which means that if what you said were to be true then conservatives would be FOR abortion. Not against it.

More Hyperbole, seeing as Kavanaugh has already said he isn't going to touch RvW and even if it does get overturned by some strange chance. Then the local states can still take it up within their own governments.

Death panel though.. nice try. We aren't that far gone for socialism yet, nor are we trying to become like Canada.

I think they willfully have an intense fever dream to get this kind of information.

This isn't a CT thread

Lol, where do you come up with such garbage? If people were using racist beliefs to decide on whether or not to be for or against abortion then shouldn't they be pro abortion as black people abort at a disproportionate rate? Being against abortion literally means you are for saving black lives.

Also, if the obvious conclusion is that the only people who are against abortion are racist and misogynistic, to what motive do you attribute to black women that are prolife?

I doubt you'll get an honest answer, but don't give up hope!
