I didn't say they didn't have a right to, I said it was a waste of money regardless of whether it is public funds or not. It still will accomplish ZERO. Those are facts and will hurt the GOP more than help them. People are tired of political games and the GOP is playing a big one right now. Bring a lawsuit IS constitutional. Any person can do it. The purpose of the judicial branch is to settle disputes under the constitution.
I said they are not using their Constitutional powers, not that it is unconstitutional for them to bring a lawsuit. There is a distinction there. Also, they may not be able to bring the suit on behalf of Congress, since it is only the House and does not include the Senate. Either way, big waste of time.

And therein lies the problem. Besides being a waste, they are not using the powers given to them by the Constitution. They are dumping their responsibilities on the Judicial branch. I expect they will just say that they are not going to touch it, there's no basis for the suite, or something along those lines. They have the power of the purse strings, and have refused to use it. They can't just ask another branch to do their dirty work.
So that excuses wasting more money? Look if this was trying to impeach the president, I wouldn't agree with it but I would have more respect for it. Not to mention the fact that the lawsuit will not even make it on the docket. Why? Because the House of Representatives doesn't have standing to file the suit. This stunt is nothing more than riling up the base for the November elections. And why not? I kinda like it. LOL.

Such a lawsuit would require the courts to police the limits of the political branches’ powers, and overcoming the natural reluctance of courts to get involved in disputes that have political overtones involving the other branches of government will not be easy.

They didn't have to fund the Obamacare law, but they did. They have "the power of the purse strings", and chose to fund it anyway, even though they have vote 50 time to repeal it.

Fair enough, but then every civil suit is a bit of theater in its own right. Personally, I have no objection to people legally challenging a head of state who is thought to be acting outside of the law - keeps them honest and let's the regular riff-raff like me know there's someone minding the business of government.
I'm sure a lot of civil suits are theater too. But I don't know.

If someone hadn't taken the President to court, his stacked Labor Relations Board would have gone unchallenged and it would have set a precedent for future Presidents to declare the Senate in recess. Sometimes theater has principle behind it.
