Please keep in mind that Steyn was not a party to the motion to dismiss, and at trial he is absolutely free to assert the truth of the claim that MM "tortured" the data.
But it wont be by Mann's testimony. Steyn supposedly would have had that evidence BEFORE he made the claim, and thats what he can present.
And virtually every normal thinking person would laugh and dismiss it as rubbish, much like virtually every politicallly motivated investigation into his work has done again and again.
You seem to be confused about the concept of 'discovery' in a civil case. There will not be 'discovery' on Mann - because it would be a tremendous waste of money by the defense. Because Steyn et al cant create NEW evidence of fraud - you cant do a fishing expedition to retroactively prove your claims (unless you're Congress).
