That actually only applies if the gratuity is stated as a mandatory service charge. Otherwise, there's no clear law on that.
If a person can't afford to tip properly, they can't afford to eat at that particular establishment.
Personally, I think we'd all be more generous, cheerful people if everyone had to spend at least a week in their lives waiting tables.
Also, if you tip poorly and return to the same establishment, expect to receive poor service from there on out. Your server will remember you and I can guarantee that they will pass along the information to any other server you may have. At the very least, the server will then devote their time to other tables at the expense of your service. At the worst...well...I'll leave that alone.
I avoid all situations where this type of "tip" is in effect.
I also don't tip, because it's not my job to subsidize an employees wages. Owners take advantage of tips by paying lower wages.

Regardless of whether it is done via a tip, or if it were to be incorporated into the cost of the food you would be paying to subsidize their wages, you subsidize wages every day, with every single item you buy.
You are just a cheapskate rationalizing your way our of spending money, and screwing someone over who is going out of their way to cater to your at the same time.. low.. very low.
Most places require a server to tip out their bartenders, and bussers ect. based on a percentage of their sales, usually to the order of 3-5% of their sales. Now say your bill was $30 and you did not tip them, they still are required to tip others based on your bill, at 3% that server just had to pay $1 out of pocket to cater to your needs jackass.
And don't feed me that "they don't report their tips" bull****. the IRS watches this closely and even if they are dishonest about it your server is claiming at least 8-10% pf their sales.. so again you are screwing them over because they are paying taxes on monies that they did not receive, all because you have some personal issue with tipping.. JACKASS.
And a reminder.. NEVER go to the same restaurant twice my friend.

I rarely go out. The last time I was in a restaurant was 6 or 7 years ago.
