ORLANDO, Fla. -- A court employee who retrieved photos and deleted text messages from Trayvon Martin's cellphone has been placed on administrative leave after an attorney testified that prosecutors didn't properly turn over the evidence to the defense, an attorney said Wednesday.

Former prosecutor Wesley White said he was ethically obligated to reveal that Fourth Judicial Circuit Information Technology Director Ben Kruidbos retrieved the data that weren't turned over.

Kruidbos was placed on leave shortly after White testified during a hearing in George Zimmerman's second-degree murder case on Tuesday. White said Kruidbos was interviewed by state attorney investigators twice before the action was taken.

The newer information is the last quoted paragraph.
They placed him on leave for exposing the truth.

Prosecutors play dirty.
I hope real sanctions come out of this.

But based on this Judge, she is most likely to claim no foul and sweep the actual transgression under the rug, as the defense has that information anyways.

Splaining?
I think the court employee has some testifying to do against the Prosecution.

And some folks believe the Defense is the only one who plays dirty, hence my comment, when they are the ones who usually play fair and by the law.

And it Officially became political the moment a special prosecutor was assigned.


At least that is what I would say. lol
Any others have a different take?

White was speaking as to that which Kruidbos informed him. Hearsay.
At the upcoming hearing, Kruidbos will be there to give his first hand knowledge.

O'mara asked for raw data, as should be the usual practice, and the prosecutor had already handed him the raw data way back in January. Why ain't he hired computer experts to extract the info from the raw data files by now?

The defense should not expect the prosecutor to spoon feed him by doing his work to hire computer software experts to extract the raw data files for him and then cry foul to judge Nelson for getting some "enhanced version" like he did with zimmerman's nose bleed picture.

You can't have it both ways, ya know?

Bingo. The defense did NOT withhold the evidence.

Too bad for the stoopid defense team they couldn't figure out how to make BIN information into readable format.

Raw data was asked for. Raw data provided. It's not the State's job, as you say, to spoon feed the defense.

As I recall,the judge asked Bernie if he had any additional information/reports/etc regarding Trayvon's cell phone. Bernie indicated he had nothing additional. This was actually pointed out in the comments sections of one of Leatherman's posts, which is sparked my memory...

It could be relevant depending on how the trial goes. Additionally, it could speak to impeachment material, depending on what was said during depositions and what is said on the stand.

I'm sure you've well heard of Diwataman. A major Z supporter. I give him credit for being one of the more thoughtful and dedicated supporters, as opposed to some of the knuckle draggers at the Treehouse zoo (and a few here).

His commentary yesterday puts a bullseye on O'Mara's silly games:

He also did nothing except just wait for the State to give him information which they didn’t have in a lot of cases. So the fact of the matter is they are both to blame. Could O’Mara not have a year ago now get Trayvon’s phone to Cellebrite? I would think so. He had the time, he had the money, he didn’t do it. He just let it sit there for months and played games with the state regarding it and the info on it that continues right up to the trial. What kind of defense attorney does that?

]But really it’s no surprise to me, O’Mara has slow rolled with discovery and with investigating Trayvon himself and he has produced virtually nothing on his own accord that hasn’t already technically been in evidence. On the specific issue just go ahead and watch the hearings regarding it and see for yourself how convoluted the matter is. I’ve listened to the first one a few times now and I can’t figure out just where exactly the defense thinks Bernie lied or hid info or what. Then the way O’Mara frames the issue in the last hearing just convoluted the matter even more.

It’s going to come down to the same argument. The state gave O’Mara the .bin file, therefore they had the photos, texts, etc. the entire time, they just didn’t pay to get it all extracted.

I've heard or him, but don't really read him. I prefer hearing opinions that contradict mine, so I mainly follow Leatherman.

In reading Omara's motion, though, he did obtain an expert to extract the data. So, Diwatman is wrong.

Additionally, BDLR indicated to the judge in the court that he had nothing further from anyone. It would appear that this may not be exactly accurate.
