Lawyer: Zimmerman prosecutor withheld evidence [W:600]

I've heard or him, but don't really read him. I prefer hearing opinions that contradict mine, so I mainly follow Leatherman.

In reading Omara's motion, though, he did obtain an expert to extract the data. So, Diwatman is wrong.

Additionally, BDLR indicated to the judge in the court that he had nothing further from anyone. It would appear that this may not be exactly accurate.
You sir, have my respect then. I too read opinions that conflict with mine, as I feel that is the best way refine your argument and or judge information. Too many people only read sources they agree with. Kudos!

...
I had a longer reply as to what you think Diwata man is wrong on, and I am too busy at the moment to cleanly detail where I think he is not, and what I wrote sounds too confusing, so I've deleted.

I guess we'll see next week how this all shakes out. Bottom line, as it is not exculpatory, I doubt it will be an issue.

Let me try one more stab: You said "In reading Omara's motion, though, he did obtain an expert to extract the data. So, Diwatman is wrong. "

The person who extracted it worked for the state. Kruibdos. Surely you don't think State employees working on the case are considered "obtaining experts." It's their own peeps.

Sorry. I guess I wasn't as clear as I thought. The defense, at least according to Omara's motion, indicates that the defense also hired an expert to decipher the BIN file.

From what I gather, and I am certainly not an expert on this, different experts may decipher different items from the BIN file. Meaning one expert might find a text message about a fight, while another expert might miss that text message but find a video of two guys beating up a homeless man.

The .Bin files are, apparently, difficult to go through and the defense could not be certain of what the pross had obtained and if the defense's expert had obtained 100% of what the state had obtained (and vice-versa apparently).

So can we agree that the title of the thread is incorrect?

Buck: That certainly is not the same argument you previously proffered.

I don't think you are right about getting differing info from the binary information. It is what it is. Raw form. Cellbrite software (Cellebrite ) and hardware will spit out what is there. (albeit laboriously)

The info was provided. MOM had a year to get that info deciphered. His problem. No spoon-fed zoup for him!

I am only taking the information from Omara's motion. I have no other source of info. If you want to provide it, great. However, Omara basically indicates that the defense's expert obtained what he could from the phone... He could not be certain if all data was obtained or if the state had obtained additional information.

Anyway, the state apparently had received additional reports, while BDLR indicated they had not. Could the data have been exculpatory? The items regarding prior fights that the state had for quite some time, possible. Can it be impeachment material? Depending on what was indicated in depoistion or what is stated on the stand.. again.. possible.

Defense Fund Spending ... General Accounting.

How Has Money Been Spent?

what does your defense spending have to to with discussing the prosecutor withheld evidence?

But since you brought it up. It is interesting that it seems the State has not revealed how much they have spent in preparing for this trial.

Lawyer: Zimmerman prosecutor withheld evidence

A court employee who retrieved photos and deleted text messages from Trayvon Martin's cellphone has been placed on administrative leave after an attorney testified that prosecutors didn't properly turn over the evidence to the defense, an attorney said Wednesday.

Former prosecutor Wesley White said he was ethically obligated to reveal that Fourth Judicial Circuit Information Technology Director Ben Kruidbos retrieved the data that weren't turned over.

I just don't get this at all. I understand what is going on, and it's sick. This is supposed to be a process of justice, not a railroad job. Put all the facts on the table, let the lawyers argue their cases and let the jury decide.

How would you like to be Zimmerman, or someone else in similar shoes and have this happen?

Those who hide evidence should be subject to severe penalties and punishment.

this kangaroo court is turning out to be pathetic.

Judge impeached and prosecutors disbarred.

given the shoddy police work, leaks of evidence, withholding of evidence by the prosecution, etc... by all rights Zimmerman should be released and the case dismissed due to procedural error. Hell, the have been cases where murderers and rapists have been set free due to "technical errors". **** as simple as a signature on a form being on the wrong line.

from day one the media and the state have conspired to deprive Zimmerman of a fair trial.

How can you not understand? From the "If I had a son..." comment this case was yanked out of the justice system and thrown into the political arena.

Corey may as well start making dinner plans with Mike Nifong right now.

for the left to keep up the false myth of rampant racism here in America they need to have a poster boy of it every now and then. when that narrative that they dishonestly created is threatened by the truth they lie, hide evidence, and do what ever they can to keep the true facts from being known. remember the Duke lacrosse team they also was rail roaded by the left using the same tactics

I'm starting to think we should build a statue in Zimmerman's honor.

I think justice has taken a back seat to politics in this case, and the state has made a decision that Zimmerman must be convicted at all costs...

Just an opinion,

In my opinion it is important to allow due process to run it's course. Rest assured the legal Authorities in Florida have successfully tried and litigated many hundreds of similar murder cases. In the racially charged atmosphere surrounding this case relying on our laws and system of jurisprudence becomes even more of a paramount importance. If any improprieties in the evidence, or handling of this case are discovered, those involved should be held accountable to the fullest extent of the law.
Finally, this case is a tragedy on all levels up to this point. Lets hope that politics and bias have nothing to do with the examination of the evidence and outcome and that justice is served based on the facts and not racial or political frustrations or passions.

Unfortunately the process here has already been corrupted with "racial or political frustrations or passions" making justice it's victim. Either way it will be hard to trust the outcome in this light.

Just an opinion,

I'm afraid you're right.

So much for impartial justice !!

Can you imagine the uproar if the state pulled this kind of crap and the man on trial was black?

Can you imagine the uproar if the state pulled this kind of crap and the man on trial was black?

as with everything else in this country...there is a definite "double standard" at work.

if GZ was black and TM had been hispanic, we'd have been treated to over a year of squeals that the only reason he was charged is because he was black.

Are these photos relevant?

more relevant than the smiling cherubic photos of a 12 y/o Trayvon that the media blasted for months after the case broke.
