State wants court inquiry of George Zimmerman

http://www.baynews9.com/content/dam...04/zimmerman-request-court-inquiry-042413.pdf

George Zimmerman's defense has released several new documents, most notably a motion from prosecutors, who want to know whether or not there will still be a "Stand Your Ground" hearing.

Zimmerman's lawyers requested a hearing last year to determine if Florida's "Stand Your Ground" law applied in the case. Zimmerman claimed he acted in self-defense when he shot and killed 17-year-old Trayvon Martin in February 2012. Martin was unarmed, but Zimmerman said the teen attacked him.

But in March, the defense said it did not need the two weeks in April that the court had set aside for the "Stand Your Ground" hearing.

Other new documents included notices that the state took depositions between April 16 and 18 of the following witnesses:

Robert Zimmerman Sr. (George's father)
Gladys Zimmerman (George's mother)
Robert Zimmerman Jr. (George's brother)
Mark Osterman
Sondra Osterman
Frank Taffee
Unnamed "Witness V."

It appears the state is requesting the defense to clarify that they are indeed waiving the immunity hearing, since George Zimmerman was not present at the previous hearing.

I guess that "wet dream" of an app let you down, as this is from a different news source.

Look at you still trying to spin what occurred.
I have no idea how many times it was pointed out to you that O'Mara left the door open for such a hearing.
This only proves it.
There was no waiver.
This is why the Prosecutor is requesting the inquiry.

And apparently it is the Prosecutors intent to force a waiver, which they can not do.

They can, have, and will.

They can, have, and will.

Utterly ignorant of the subject and an absurd answer.

No, they can not force a waiver.
No they have not forced a waiver.
And no, they will not be able to force a waiver.

Any waiver made will be done so freely and voluntarily.
It can not be forced.

They will force the defense to acknowledge the waiver, not forcing them to waive the actual immunity hearing.

There is and has been, no waiver to acknowledge.
O'Mara purposely left the door open.
This has been shown to you multiple times. You just purposely fail to understand it each and every time.

wut? you must have me confused with someone else

If you want to play stupid, be my guest.

If, as you say, the evidence is clearly in favor of Zimmerman, why did the defense cancel the immunity hearing?

Why punish yourself for over a year, when you can be protected from criminal and civil liability?
Did you not read and hear what O'Mara said?
I am sure you did, as it has been previously pointed out.

So why are you playing dumb? There must be a reason behind it. So why?

Where exactly did Mark O'Mara state something to the effect of "We are looking into the possibility of pursuing the immunity hearing at a later time"?
You must be trying to impress new found friends or something.

You keep asking for what was not said.
He stated that the door was still open to the possibility.
That means there is no finality to what they have decided to do.
Do you really not know that?

I am going off of what Mark O'Mara has stated on record. No second guessing going on here. I am taking what Mark O'Mara has stated.

Per Mark O'Mara himself:

1. They only have time to prepare for one thing, immunity hearing OR trial, not both. If they have said otherwise, prove it.

2. George WANTS to be acquitted by a jury. If they have said otherwise, prove it.
Yes he said these things. But you seem to forget that he stated with agreement of the Judge, that they could if they wanted to, roll the SYG hearing into the trial, and later in a press briefing after that hearing, stated that the decision had not been made yet.

O’Mara previously stated that he hopes to roll the “stand your ground” hearing into Zimmerman’s second-degree murder trial, scheduled for June. He said that remains his desire. The judge has said she’s open to that.

The points being, that you were told, and that no waiver has yet been made.

Watch the whole video man:lol:

O'Mara: Part of the decision to not have a hearing... (07:50)

That does not sound like they plan to "roll it into trial". If you actually bothered to watch where he talks about it, he is saying it as a possibility. A possibility they do not plan to pursue, due to Zimmerman's wishes and $$$ issues.

Like I said, If you want to play stupid be my guest.
I didn't actually think you would continue. Doh!

The very beginning of the video.
Duh!

Q: Are you going to have a simultaneous immunity hearing during the trial?
A: Haven't made that decision yet. ...

Since you obviously need to be informed again - That is him leaving the door open.

And had he actually waived the hearing there would be no reason for the prosecution to ask for clarification. Duh! Doh! :doh

Wrong!

He clearly says he has not made that decision yet.
Stop playing dumb.
What you point out is his stating why he wasn't going to have the hearing during the time the Judge had set aside for it.
Which has absolutely nothing to do with his leaving the door open.

Dude, you are not getting it

The pre-trial hearing vs still being able to file, the motion before trial

He has to be getting it.
No one is that obtuse unless it is purposely being done.

Do all cases take this long, or just the ones that Obama opens his mouth about?

Thanks for providing information on the progress of the case. I feel bad for you because you are only trying to update people on the status of the suit and all you get are personal insults from Zimmerheads. Constantly being proven wrong must really be wearing them down.

Keep up the good work!

I actually find amusement sparring with them, so it's not all that bad:lol:

Thank you

You constantly and consistently being shown to be wrong is now sparring?

Defense has a agreed that Zimmerman will show.

He's going to have to talk to the judge directly for at least a minute without lying.

I'm sure Omar and West's ulcers are burning.
