Bad News For Team Zimmerman: No Immunity Hearing, No "Star Witness Bombshell"

Lawyers acting for George Zimmerman, who shot dead the unarmed teenager Trayvon Martin on a Florida housing estate, have abandoned their attempt to have his murder charge thrown out on the grounds of self-defence.

"The real focus is going to be on getting ready for a jury trial," O'Mara said at a hearing on Tuesday in Sanford, close to the Retreat at Twin Lakes community where Martin had been staying with his father on the night of his death.

"As you know I've been counting. We're only at 96 days [from trial] right now. So that only gives us time to really get ready for one hearing. And that's going to be a jury trial where he gets acquitted. George wants to have a jury of his peers decide the case."

If the defendant had a legitimate claim of self-defense, the immunity hearing would have taken place long ago and the defendant would be a free man.

Mark O'Mara via numerous interviews and court proceedings over the last year lead everyone to believe he would pursue a SYG/Self-Defense Immunity Hearing for his client George Zimmerman. His admission yesterday to not even attempt an immunity hearing leaves them with one course of action: Character Assassination.

I wholeheartedly agree with their course of action. If I murdered a teenager walking home from 7/11 and had no legitimate claim of self-defense, I would also resort to these tactics. I wish them luck. Just being real here.

The media hype to create W8 as some sort of "Star Witness" is false.

Not to diminish W8 importance to this case, but I believe she will be one of the last witnesses called to the stand, confirming what the evidence in the case has proven, which is Zimmerman's guilt, and will not be used to place Trayvon or Zimmerman anywhere. She will just be used to confirm Trayvon did indeed run from Zimmerman. Nothing to see here.

Don't fall for the "star witness bombshell" media hype. They are creating a false equivalency between a non-issue and legitimate perjury to generate more hits on their news sites. The deposition will clear everything up.

Where did you come up with character assassination? I would bet on a self defense angle, straight up. It is hard to assert that a "running away person" managed to end up on top of and beating the one that they ran away from, after their "star witness" says that they were talking to them after approaching them. Did she not state that TM first spoke to GZ?

Doesn't their choice leave Z open to a civil suit even if acquitted?

I thought that was the whole point of SYG laws in FL

I find it odd that TM was unable to outrun GZ, being a few yards from "home" and a HS football player. The GF of TM stated that TM talked to GZ prior to the altercation, yet never mentioning a gun or running away, simply that he was being watched/followed.

Both SD and SYG can still be persuaded at trial

I don't know the nuances of the use of SYG as it relates to elimination of civil liability. You may know, and you may be right.

Yup. It's all just a happy coincidence that after Leatherman makes a post, you post a comment here echoing the same things even using the same words. This even though you could have made the same responses when I first posted the relevant topic that you responded to - you know, prior to Leatherman's response. But, we know you couldn't make these exact same arguments, as leatherman had not yet come up with them for you to regurgetate.

Oh, I figured this was coming - yes, I had just read the blog post. Leatherman is wrong, and we know he is wrong as he even says in the post that he knows this has occured in Florida in the past. So, I can't say that he will persue both, but Ric is correct that they can pursue both.

If OMara believed that George could prevail in an immunity hearing without testifying... he would have done so months ago and George would be a free man. I don't really know what OMara is doing other than stalling and whining.

Trayvon didn't play HS football.. He played in the OPTIMIST leagues which top out in the 8th grade or at 150 pounds whichever comes first.

UNless they just aren't ready for the SYG hearing. They still have to prepare for it with experts and depositions. It's not magic.

As to the angle of the shot, it is entirely incorrect to assert that Zimmerman could not have made the shot at that angle (see Spitz & Spitz, The Medicolegal Investigation of Death). It is quite possible; try it (without bias).

I realize that Leatherman has told you not to like Knox, but I would tend to believe a forensic evidence with an impressive resume of testifying to the courts over some internet blogger...> But that's just me.

Leatherman hasn't told me anything.... and I don't know anything about forensics.

Here is the problem. I don't have any idea about forensics either... So, I would have to rely on experts, not anonymous internet bloggers. Again, though.. That's just me.
