For good reason said decision is made by a Forensic psychological examiner (forensic health professional, etc) according to the standards set up by the court/state - some common practices are that the FPE cannot form an opinion as to whether that person's guilty or not - nor are they called to the stand as a witness. To properly examine someone's overall psychological state they must be removed from 'the case' and approach it clinically.
Apparently this is a very GOOD thing seeing as how many normal people are considered 'insane' by random citizens after killing someone in any fashion.
If you met someone who was truly insane you'd have a different view
And on that note - why do you want him to be found insane, by the way? Usually people don't want a murderer to be found insane - they want them to be found able to stand up to trial in court and take all that's coming to them.
I never used the term "insane"..
