Show Probe is Unconstitutional Under Article II (VIDEO)[/h]According to Politico’s reporting, this special status given to Mueller’s lawyers theoretically allows them to rove around and pursue matters outside of the special counsel’s mandate.

Since Mueller’s lawyers have dual status as US Attorneys, that makes Mueller a US Attorney rather than a Special Counsel. Only a President can appoint a US Attorney. By appointing Mueller, Rod Rosenstein usurped the President of the United States.

So what he's saying is that Rosenstein (the Republican Assistant Attorney General who works for Sessions and Trump) doesn't know the Constitution. Republican Jeff Sessions, who is the most senior lawyer in the country, doesn't know the Constitution. Republican lawmakers don't know the Constitution. The President of the United States doesn't know the Constitution. Well, okay on that last one - we all know he never read the Constitution.

But Mark Levin is the only person in the country who does know the Constitution.

This reminds me of parents watching their son in a marching band of 100 people, and their son puts his left foot forward when everyone puts their right foot forward, and Dad says to Mom "Look at that. Isn't it wonderful? Everyone is out of step except Johnny."

Levin is an embarrassment to himself and the clueless people who listen to him.

As I see from the responses so far, this went right over some people's heads, as they chose to completely avoid commenting on what Politico put out.

In a nutshell, for those with their head in the sand, Manafort argued that they've gone beyond their scope in prosecuting him. Mueller's team came back, basically saying, no, no, we have the power of a US Attorney. They just showed that they are unconstitutional (not just because they say so), since Mueller was not appointed by the President, not confirmed, and that Rosenstein does not have the authority to make such an appointment. Rosenstein should resign or be fired immediately.

That's the point, which you got zero responses to.

Judge Ellis is right to be skeptical. Mr. Mueller’s investigation has crossed a constitutional line, for reasons the U.S. Supreme Court made clear in the 1988 case Morrison v. Olson. That case is best known for Justice Antonin Scalia’s powerful lone dissent arguing that the post-Watergate independent counsel statute was unconstitutional. But Chief Justice William Rehnquist’s opinion for the court, while upholding the statute, set forth limits that the Mueller investigation has exceeded.

At issue is the Constitution’s Appointments Clause, which provides that “principal officers” must be appointed by the president with the Senate’s consent. Rehnquist wrote that independent counsel Alexia Morrison qualified as an “inferior officer,” not subject to the appointment process, because her office was “limited in jurisdiction” to “certain federal officials suspected of certain serious federal crimes.”

Mr. Mueller, in contrast, is investigating a large number of people and has already charged defendants with many different kinds of crimes, including - as in Mr. Manafort’s case - ones unrelated to any collaboration between the Trump campaign and Russia. That’s too much power for an inferior officer to have. Only a principal officer, such as a U.S. attorney, can behave the way Mr. Mueller is behaving. Mr. Mueller is much more powerful today than any of the 96 U.S. attorneys. He is behaving like a principal officer.
