Constitution gives Trump license to kill

A loophole in the U.S. Constitution, expanded by Congress, lets the president of the United States murder his political enemies with impunity.

Until 1971, persons who attempted to assassinate members of Congress, a candidate for president or vice president, and various other high federal officials were prosecuted by the state in which the offense occurred.

Congress found this situation to be unsatisfactory on at least two counts: 1) Persons who committed assassination faced widely varying sentences and could escape the death penalty, and 2) Local jurisdictions might not have adequate resources to effectively investigate and prosecute a case.

Legislation, effective in 1971 and amended through 1996, seemingly remedied this by making it a federal crime, punishable by imprisonment or death, to kill members of Congress, members of Congress-elect, department heads, the CIA director and deputy director, presidential and vice presidential candidates, and federal justices and justice nominees.

While supposedly deterring any assault against their exalted beings, members of Congress failed to grasp that making their assassination a federal crime also made it a crime eligible for a presidential pardon. Article 2 Section 2 of the Constitution provides that the president “shall have Power to Grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment.”

That means a president could freely send forth his minions to kill any member of Congress, the Supreme Court and any presidential candidate and then, when the assassins are arrested and indicted, grant them pardons so they can be released and carry on further assassinations as required. Eliminating or intimidating a sufficient number of uncooperative senators and representatives would make impeachment a moot point.

It is interesting but I wonder if it would survive a legal test.
Of course with the SCOTUS and Congress we have right at the moment, it does tend to make one shudder.
After all, if you could think of this, it means several people at the White House level can think of it, too.

Hmmmm..... I have to admit that my first glance at your thread title was that it had to be horse****, but then I read your OP.

Interesting conundrum. It wouldn't be with impunity, because the Impeachment Clause is there, but it wouldn't prevent it from occurring, just stop it from occurring again by the same person.

Except we have elections in 12 weeks. Unfortunately, Georgia became the latest ‘public’ state broken into by Russians, on every drivers license and last 4 digits of every registered voter in Georgia.

With the same probing of pivotal counties in three states we know of — Missouri, Florida, Georgia. In all three cases, traitorous GOPs are doing nothing at best and mocking it to get worse.

In all cases, GOPs stand in the way of paper ballots. We also know that 21 total states were hit like this in 2016. We have No Clue as to the Validity of our Election Infrastructure.
 
This is a very disturbing scenario which I would never have thought of. I hope there are legal impediments to it which neither of us know of.

The President's position would not be invulnerable:

(1) Congressional quorum waiver, impeachment and conviction would carry immediately by voice vote without debate in both houses.

(2) The President has no authority to pardon for state as opposed to federal crimes, so he would be liable for any murder carried out outside Washington DC. Extradition legislation would pass with the same dispatch as in (1).

But even the best result of your worst case scernario leaves me thinking that constitutional amendment is needed.

well, when we have a Russian mole in The White House giving the nuclear codes to Putty Putin & we have 70 year old white males wearing T-shirts with the slogan, "I would rather be a Russian than a Democrat" everyone on god's green Earth knows we are pretty much ****ed .............
 
But then again notice that The Onion can't even keep up with the reality these days.

So very true; one more reason I stick to reading the comics section in newspapers....at least it does not pretend to be unbiased.

Except for those of us on Our Creator’s Green Earth. My yard/gardens complex has all kinds of Butterflies, Gold Finches, all kinds of Cool Creatures.

It was one of our Moderators who coined the term ‘Garden of the Gods’ to me. I’ve taken that one forward to speak with those who’ve lost Loved Ones, Creating Their Garden of the Gods.

I still have that Donation Bet Going for before Labor Day. I didn’t expect the Good Fortune of Omarosa. McConnell is sweating. His Wife is in the Cabinet. This is why we have a 25th amendment.
 
Even if it wasn't pardonable, a President already has the resources to have someone in the US killed without it being traced back to them. Hell, it would probably look like an accident or natural causes.
