How to address 50 years of fraud by VA?

This would seem straight forward. Two pages to prove fraud is happening. The problem is this is so toxic that no one will help. This is not he said she said. One page is the Federal statute the other is a county commissioner stating that the Veterans Service Officer may not put in claims the VA doesn’t want. I’m poor and dying from Agent Orange from South Korea below the DMZ.
I’ve tried everything I know (papers, TV, congress, White House, Lincoln County Sheriff, Lincoln county DA, Newport Police).

This would seem straight forward. Two pages to prove fraud is happening. The problem is this is so toxic that no one will help. This is not he said she said. I’m poor and dying from Agent Orange from South Korea below the DMZ.
I’ve tried everything I know (papers, TV, congress, White House, Lincoln County Sheriff, Lincoln county DA, Newport Police).

From what I can see, on a cursory reading of the portion of the second document provided in this OP, the operative term repeated several times is "may" as in "may be established," "may also be granted" followed by "the VA is responsible for determining whether the evidence supports the claim..., or whether a preponderance of the evidence is against the claim."

So the question regarding YOUR issue is; has the VA determined that YOUR medical issues are service connected under the guidance you provide in that second letter...or not?

If you have such a determination, then services cannot be denied you. If you don't, then you do not get the services.

I hate to be the bearer of bad news but IMO the 'government' does not give a rat's ass about any veterans; WHY do I have this opinion?
Allow me to explain. I reside in Ramsey County, Minnesota, Saint Paul to be exact. I was previously employed by a company that services disabled persons, with all of all types of disabilities. Many of the individuals our company serviced are US Military veterans. Many of these individuals frequented the local VA hospital which is located just north of the MSP airport. I worked personally with many of these US Military veterans. I was able to converse 'one on one' with many of these veterans, and I have to tell you, I have some stories that will break anyone's heart, that has a heart. The greater majority of these US Military veterans that I had the honor to converse with relayed to me stories that are replete with opinions of a stagnant government that has no regard for the individual; a government & a bureaucracy that basically runs roughshod over the very citizens that the government is supposed to be serving now, citizens that have given pretty much all they have to give to the nation they call 'home'. I met & conversed with several former veterans that are affected by Agent Orange; they all have a very similar story to relay, which is as yours; terrible. Again, you can only do so much when you are attempting to alert a dead government to the realities of those that have served & that are now being slowly put into their graves by not only their past physical realities but also the very government they served that is now unresponsive. You have to keep trying but that may be all you will ever have; these government yahoos may never help you beofre you take your last breath. I am sorry to tell you this; I have seen this before & it sucks beyond belief. Uncle Sam takes & takes but in the ned Uncle Sam never gives, much ..................

I'm being totally taken care of medically by the VA, tumor on Adrenal gland that caused major stroke etc.

You see the problem is, it was a war crime to use Agent Orange outside the DMZ of South Korea.

My reading seems to me that you are claiming use of Agent Orange near the DMZ in South Kores. If the gov't does not admit using Agent Orange in that area, you will never recieve anything. You will be required to produce evidence/witnesses that can verify use in that area and the time period. Without that, you will never get anything.

Yes, I wanted to be sure I had done everything legal first. Thanks for being so frank. That means a lot. We are letting 20 veteran die everyday of despair.

governments in general are nothing more than a mafia; they use those they 'claim' to protect; LOL, protect, and then once they finish 'using' you they toss you a side like some cheap whore. There is no accountability within any government & if ones actually receives any accountability from government then that is just dumb luck .......

So I got a 60% disability rating for my service. It was pretty straight forward and took about 8 months to qualify. While sitting in the waiting room to see a specialist to help process my claim I heard all manner of silly attempts to boost veteran's claims- car accidents long after leaving the service and such. Bottom line is the claim has to have military medical records to support the claim. There are a few exceptions.

I have never heard of Agent Orange used in South Korea. I don't recall any exception for claims not supported by the service member's medical records for agent orange in Korea. I think you are out of luck... :peace

If you’re 65 or over, of course, Medicare will pay your expenses assuming you were never successful signing up with the VA for your medical care. If I were you and alone, which I am except for friends, I would call your village offices to ask who you could contact to see what services you might be entitled to that are either provided by them, your county or state. There are social service agencies that can help you.
 
what does your VSO/Devin Whittaker suggest you do to establish your claim?
what is he willing to do to help you acquire that documentation?
i share this article (cite below), not because it helps you directly, but because it lauds the efforts of the VFW to push thru the benefits realized by Korea veterans of a later era, who were subjected to AO and other toxins
my father died of pancreatic cancer soon after the USAF/VA acknowledged (44 years later) that he and other airmen were subjected to harmful radiation when they were required to fly thru mushroom clouds after WWII to measure the immediate effects of radiation exposure. while it did not help him, it helped my Mom, financially, as his surviving spouse
as a loadmaster, he transported lots of AO to and around vietnam during the war. his cancer could have been a natural cause, or from AO exposure, or from the radiation
he was active in the VFW, pushing congress for a favorable determination. would encourage you to do the same
another avenue might be to identify an attorney who has a positive history of handling similar claims, as (s)he will have the research you need to move your case forward. maybe devin whittaker will help you find that lawyer

Do you think the government will give you your South Korea health care records. I waited nine months to get all available records. No South Korea health care records in file.
 
Yes, I have retained(in works) a East Coast Group to handle my claim correctly. They have no problem with my evidence and they specialize in South Korea claims. They are taking it for a percentage of winnings. What my VSO should have done without the percentage.

I am more concerned with the twenty veteran suicides a day.............
