    If it's not about rights, why does it talk about rights?

    If it is a 'rule of construction', why does it not mention something about that?

    I think you would have to explain how that relates to this.

    Ninth Amendment - Unenumerated Rights
    The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
