Would Trump Refusing to Answer Press Violate the First?

I suspect it's legal.

But it is not conducive to transparency and the democratic process.

I'd impeach Trump on general principle if I could. But unfortunately, I don't see anything specifically impeachable here.

Unless Trump quits signing GOP bills, or tanks in popularity amongst the GOP rank & file, he's safe.

Barring the Dems gaining control of one of the Chambers, though. But I see that as unlikely.
 
Regarding press conferences, Trump can speak to the press in writing. The press conferences are turning into a "gotcha" contest, with little relevant content coming out to the public. I'd recommend trump communicate by written memo for accuracy's sake. The press used to report the information, then the editorial writers would editorialize. Now it's all pretty much editorial with one proveable story printed with different "outcomes" by different news outlets. I's surreal.

The problem facing the Dems is the changes Trump made early on, particularly dumping Obama era executive orders, and going to be showing up in economic activity late this year and into the 2018 election year. The optimism of businesses looking forward, is a positive development, but the news outlets have Trump living rent free in their heads and cannot print an accurate story about Trump without being dis invited to the Press Club.

As long as the economy is improving, Trump is in good shape, and the democrats don't have the votes to stop it.

Basically, the democrats are fighting to return to the moribund economics and social engineering of the Obama era. We'll see how that plays out in 2018.

Most of the impeach crowd don't understand the line of ascension, and expect Maxine Waters to replace Trump.

I don't think that Trump, of all people, could possibly remain silent - he spews out stuff constantly whether asked to or not.

He never said he would stop talking, just not to the press.

It would be another idiotic mistake which couldn't be explained away as inexperience. In that Trump is an authoritarian his attempting to do so wouldn't surprise me.

I don't see how legality comes into play.

He cannot punish them for the content of their speech (there are also some limits on time & place restrictions for speech), but the press doesn't have any sort of a right to someone else's speech.



As for impeachment? That's supposed to be about high crimes and misdemeanors, although there's no mechanism to stop misuse of impeachment while it's going on. There's only punishing those who misused it after the fact with votes.
 
It isn't a violation of the first amendment if he refuses to answer the press. The first amendment protects the rights of the press to report what they feel should be reported. It also protects freedom of speech which could also include the freedom to not speak if there is nothing to be said. I would disagree with Trump if he cut off all contact with the press completely, but he does have that right. Freedom of the press does not mean that they have the right to force someone to answer their questions.

no, there's nothing in the first amendment that requires a president to field questions from the press. cutting off all contact with the press would be a colossal mistake, though. even threatening to do so was a mistake.

I don't think he would do that. However he could do as Obama did and limit which reporters he will take questions from. Perhaps that might force CNN to grow up a bit.

Yes it is legal. The 1st Amendment applies to the President of the US just as much as it does the press. And part of the right of free speech is to shut up. I do wish that Trump would take more advantage of that part....

Come on, nobody has to answer the press, ever. They are not a court of law, they have no legal power to expect anybody to ever answer anything. WTF is this idiocy even being asked?

And is it legal? Again, what legal right does the press have to demand answers from anybody? And what legal reason does anybody have to answer them? Stupidity in the extreme in action here.

As far as "cutting them off", let me know when President Trump goes 87 days without talking to the Press. That is the current record (86) for a President to refuse talking to the press. And that record is held by the last President.

There is no requirement that the President of the U.S. speak to the press or anybody else. He has representatives that can do that for him. Impeachment is indicated for crimes, not for communication that you don't like.
 
Of course it is 100% legal for him to not answer the media's questions, or anyone's question's. Why would you ever think that that would violate the 1st amendment of the U.S Constitution? It obviously, inherently, gives you the right to not speak.(Not actually, but it isn't necessary to give you that right. It is inherent, as there is no law restricting such a thing.)
