Supreme Court formally asked to overturn landmark same-sex marriage ruling

“Ten years after the Supreme Court extended marriage rights to same-sex couples nationwide, the justices this fall will consider for the first time whether to take up a case that explicitly asks them to overturn that decision.

Kim Davis, the former Kentucky county clerk who was jailed for six days in 2015 after refusing to issue marriage licenses to a gay couple on religious grounds, is appealing a $100,000 jury verdict for emotional damages plus $260,000 for attorneys fees.

In a petition for writ of certiorari filed last month, Davis argues First Amendment protection for free exercise of religion immunizes her from personal liability for the denial of marriage licenses.

More fundamentally, she claims the high court's decision in Obergefell v Hodges -- extending marriage rights for same-sex couples under the 14th Amendment's due process protections -- was "egregiously wrong."

"The mistake must be corrected," wrote Davis' attorney Mathew Staver in the petition. He calls Justice Anthony Kennedy's majority opinion in Obergefell "legal fiction."

The petition appears to mark the first time since 2015 that the court has been formally asked to overturn the landmark marriage decision.”

Hopefully, not another Dobbs decision. Worth noting 3 of the 4 dissenters (Roberts, Thomas, and Alito) in the 5-4 decision.

Associate Justice Kavanaugh has jurisdiction over Kentucky as the circuit justice for the Sixth Circuit, so the writ first goes to him.

The hypocrisy of those that claim to be all for “freedom” and the enjoyment of the inherent right of all Americans to “Life, Liberty, and the pursuit of Happiness” is gobsmacking.

I don't think it will be overturned

However ... its also a license granted by a State only and therefore its not so much unlike a gun license. One state allows people to buy guns, others don't. Different rules and regulations apply and even different rules/regulations apply in marriage licenses too from State to state and who can get them and when etc

So like abortion, it might be left to States

Remember Arkansas voted to be same sex only state and the Fed Govt / Judges stepped in and said no no no the Will of the People doesn't matter

Constitutional arguments aside for the moment, Obergefell v Hodges and Dobbs are very different in that the implications to those affected by the overturning of the first will reach further (figuratively and literally) than those affected by the latter case.

Federal entitlements/benefits currently extended to same sex marriage partners, life/health insurance policies involving interstate compacts, and likely other matters.

My belief is let love decide, not the government.
That’s a nice bumper sticker. But love doesn’t get to decide the applicability of government benefits.

FYI there is no Right to marriage in the Constitution

its a State given license

If one marries in one state, is their marriage valid in another state?

can I bring my AR15 from Arkansas where I have it legally to a city where its banned ?
 
Why? What is accomplished but not recognizing gays and lesbians as just folks like the rest of us?
Equal rights in a country that is making every attempt to have them overturned
Voting Rights Act is all but repealed under SCOTUS
