An attempted burglary very near our home resulted in the burglar being found dead in their car nearby. Hopefully, this news will help deter other burglars from thinking that a rural area offers them easier pickings.

UHLAND, Texas (FOX 7 Austin) - An Austin man was found inside a vehicle shot and "appeared to be covered in blood" by police Saturday morning.

Hays County Sheriff's deputies responded to a call of a suspicious vehicle in the area of Grist Mill Road and South Plum Creek in Uhland around 10:45 a.m. May 25. A single occupant of the vehicle appeared to be covered in blood.

Deputies determined the man, later identified as 35-year-old Matthew Aaron Kellas of Austin, had suffered gunshot wounds. Kellas was transported to a local area hospital where he was pronounced dead.

According to HCSO, a woman called shortly after the suspicious vehicle call and reported that a man had attempted to break into her home and she shot him. The home is located within close proximity of the car where Kellas was located.

The investigation is ongoing and no further information was available.

First, congratulations to the lady for her courage.

Second, I hope that she gets some counseling, for being a victim of violence is traumatic.

Third, I have no sympathy for individuals who commit crimes of violence.

I hate to see a loss of human life, regardless of the situation. But before we cheer with celebrations of "a job well done", let's wait until the police finish their investigation. Right now, all we have is the women's claim, and a dead guy that can't speak. If these two individuals are related, the story may not be what we think. Ten again, it may. We shall see.

The fact that there is an investigation ongoing, combined with the timing of the calls to the sheriff, makes me think (suspect?) that there may have been some other connection (prior or ongoing relationship?) between the shooter and the dead man.

I have similar thoughts - see post #5.

Yep. Greed and passion. The prime motivators of the human condition! Which is it, here?

It could be both - she tossed him out (ended a passionate relationship?) and he (greedily and passionately) wanted back in.

Fair point. Or just as possible, she didn't want to let him walk out the door!

But I will also say this: Daytime burglaries are not uncommon in some neighborhoods. Though a Saturday one makes no sense to me, unless the perp had prior knowledge of an unoccupied residence.

And by "greed", I meant something of monetary value.

I only read whsts here in the thread but questions definitely come up for me.

For instance where was he shot, in her home or in the car?

As of now, there is no known relationship between the two (even after hearing from the most "busy body" among my neighbors) and the dead man had an Austin address. With the vast majority of my neighbors being armed it is not a good place to try to commit crime. When the last flood of Plum Creek caused loads of wild pigs to seek higher ground it sounded like a war was going on as folks sought to get some of that free pork.

And as the TTWTT brought up: Why did the shooter's call to the police come-in after the body was discovered?

From what I have heard (via local gossip) the shooting was at her home and his car (containing his body) was later found about 1/2 mile away from her home. I have not heard that he was in the car when shot, but assume not or she would likely have been arrested.

She was not a victim of violence... she was the one that committed the violence...

That (bolded above) remains to be determined - thus the matter is still being investigated.

In Texas the use of deadly force laws are more favorable to the shooter than in many other states.

WHEN IS DEADLY FORCE JUSTIFIED IN TEXAS?
Under Texas law, the use of deadly force to defend yourself is justified if: 1) the actor would be justified in using deadly force to defend against an attack because the actor reasonably believes that deadly force is necessary to protect the actor from the unlawful use of force; or 2) when the actor believes that deadly force is necessary to defend against illegal use of unlawful deadly force. In layman’s terms, this means if the average person is in a situation where someone is using unlawful force, deadly or not, in an attempt to harm the person in question.

Yes, she should have waited until she was attacked, raped, injured or otherwise in grave mortal danger before defending her life. The guy just wanted her stuff, how dare she think she should be able to prevent theft and or injury!

So you condone just shooting people before they have presented themselves as a viable threat? Great.

If someone breaks into my home, yes I will shoot them without regret or hesitation. AS it so far, appears she did.

A burglary is not a violent crime. If in fact it was a break in and she shot him, good for her.

And you might get charged with aggravated assault or manslaughter or murder...

Not in Texas... why the hell would you charge someone with any of that for defending their home?

So she says, taking advantage of Texas law? Is there any evidence he broke in?
