Federal suit claims state law violates US constitution

State education chief admits law rests on shaky ground

It is against state law in South Carolina for public school sex education classes to mention anything other than heterosexual relationships, unless the talk involves sexually transmitted diseases. A federal lawsuit now aims to change that.

South Carolina's gay marriage ban struck down in federal court

The National Center for Lesbian Rights and Lambda Legal said their lawsuit filed on Wednesday seeks to overturn the Comprehensive Health Education Act of 1988 as an unconstitutional violation of the equal protection clause of the 14th amendment.

This law is certainly not 'equal protection.'

“The law singles out LGBTQ students for negative treatment,” a news release introducing the lawsuit said. “It prevents LGBTQ students from receiving any health education about their relationships except in the context of sexually transmitted diseases, without imposing any comparable restriction on health education about heterosexual people.”

Probably be filed in the US District courthouse in Columbia.

It's a damn good thing that us heteros don't pass the nasty.

quite frankly the state is wrong on this and they will likely lose in court...and then they will decide not to provide sex education at all....this is still a very socially conservative state...even amongst left leaning residents.
Personally, if we are going to teach sex ed, we need to teach safety first and then be open and honest about all of it. AIDS/HIV doesn't discriminate nor does any other STD.
