So they are saying that she gave this baby weed to smoke on at least two different occasions. Holy Hell! This is simply wrong. Even if marijuana was legal in NC (it isn't) and the US, and the child had both a medical need and prescription for marijuana or (more likely) one of its ingredients (THC, cannabis, or CBD), it would still be wrong to give it to a baby in that way. I'm even considering looking into CBD for my son to see if it might actually work for his seizures. But it would not be given by smoking it.

I'm actually for legalizing marijuana for recreational use by adults (minimum age 18) and having the same restrictions as smoking tobacco placed on it. However, I think medical marijuana, whether recreational smoking of marijuana is legal or not, should be limited to actual healthy intake mediums. There are other, more reasonable and efficient ways to get whatever ingredient helps your medical problem that comes from marijuana than smoking it.

Actually, I believe it was a “blunt” - a cheap cigar hollowed out to receive marijuana so as to disguise the smell. Who here hasn’t given their child a cigar filled with dope? Uhhh.... no one, I hope!

What is actually wrong with it though? The State is going to lose this one... invasion of privacy for one.

Obviously not the sharpest tool in the box if she thought doing something so incredibly stupid was a good idea and still thought to post it online for everyone to see. I agree with the felony child abuse charges and hope this baby has someone who can actually take care of her.

No they're not going to lose this at all. It is illegal to give a baby a cigarette, let alone what they are saying contains marijuana in a state that has not legalized marijuana. And she posted the video on Facebook, where others reported it to the police. No invasion of privacy there.

Facebook is private...

Not once you post it to publicly be viewed by others. It then becomes public. They were not hacking into her account. They were people she was friends with. This is no different than a friend, family member, or invited guest coming into your house and witnessing you give your child a blunt or cigarette and reporting you for doing it. That is not an invasion of anyone's privacy. Not legally.

Not just from the video, no. But that is why they have an investigation. Likely they tested the baby and asked the mom and other family members questions. They even said that they first believed it was simply a cigarello (that was the first report). So obviously they have gotten further evidence that it likely contained more than simply tobacco, marijuana. Even if it was just tobacco, she could likely be charged with most of the other things in relation to the baby smoking. Additionally, if they found marijuana in her possession when they did go to question her about the baby smoking, then it could easily lead to the marijuana possession charges.

Are you simply playing devil's advocate here? There is little logic in this line of debate. It is one thing to say "well she should get to decide what her child intakes" or "maybe she felt the child was having problems and she couldn't afford other forms of medical help for her baby", and quite another to go on about things that are legally irrelevant or illogical.

There is a reason she is facing a trial. Witness testimony would be judged there, if relevant. The police did not invade her privacy by her friends on Facebook, people who she decided could see her posts, reporting her for posting this behavior. Doing this does fall within the purview of child abuse, as determined by most "reasonable" (which is the prevailing legal setpoint) people. Whatever was in the "cigarello", cigarette, joint, or cigar that was producing smoke can be accounted for by tests, which would be included almost certainly in an investigation.
 
Not from the video but I believe it gives them enough probable cause for a urine or blood test.

Second hand smoke can bring about positive test results.

Yes they do. So what exactly does that have to do with this? She posted her child smoking something. Again, even if simply a cigarette (with no marijuana), it would still be child abuse. She would still be facing pretty much the same charges. And since she hasn't actually gone to trial yet, we don't know what evidence is against her beyond the video.
