Should incest be illegal?

Incest is the first universal taboo in human society, before cannibalism. It makes sense that you will find a thread on it troubling.
But freedom isn't about making anything you'd find troubling illegal. If you truly believe in freedom and liberty, you wouldn't be in favor of making it illegal.

Honestly, I'm still a little floored that there's any pushback from reasonable people this at all. It's incest. Is this really the next taboo to be broken? Personally I was hoping for bestiality...there's just something about poodles....

I understand how unpalatable incest is for you. But what is the reason why you think it is and should be illegal? Is it solely because you find it unpalatable?

some people feel the same way about sex with ugly people, fat people, skinny people, interracial couples, gays etc :shrug:

I too think its wrong but that doesnt mean i support a law against it, theres no rational LEGAL justification for it.
Especially felony charges thats just insane.

I dunno...you know me and not wanting the judge job. I don't even know what the current penalties are. Incest is one of those things I have no problem deferring to the pros on.

Also, careful with that "step one complete" stuff, I built room in for exceptions...in fact, I'd insist on it being called the SkyWalker clause...hehe... Don't misrepresent me now, friend, I don't wanna get grouchy. ;)

I might as well get this out of the way. I've been giving this a lot of thought, as open mindedly as I could, and I realize that I might be prejudiced as a mofo here. Maybe there's a point at which society will be cool with this, but that is not today. And until we fix the fact that 38% of *reported* sexual assaults are at the hands of family members, normalizing incest is probably a bad idea.

I am perfectly comfortable with whatever this says about me. :)

Sex with an animal is cruel because animals are not capable of consent. A corpse is a public health hazard and no one can legally own a corpse. However, if you somehow managed to gain legal ownership over a corpse and rendered it harmless to public health, I would feel that I would have no authority to tell you what you are allowed to do with it in the privacy of your own home, no matter how disgusted I might be.

Debate politics alone is proof incest is alive and thriving. There's more than a few around here I suspect are the result of their parents being brother and sister. Whatever, not something I would involve myself in but if they are all competent consenting adults, I could care less.

Not true. In ancient egypt the ruling class did use incest as a basis for marriage. In fact royalty has nearly always has exemption from incest taboos.

No. Some people consider sex for anything other than procreation is gross and immoral. Others anything other than missionary position. Some feel that cunnilingus, fellatio and doggy-style are gross and immoral. I'm not one of those people.

Actually the laws against incest are based on the idea that it is not consensual but is a case of a younger member of the family being forced to obey the ruling of an elder. Which is the usual case of incest brought forward to the courts. I am not aware of anyone being held up in a court for producing an offspring. Perhaps you could provide a link to back you that it is illegal because of the idea that a child may result.
 
ahhhhh just did some reading and it seems the orgins of incest laws were based basically on child rape, a way to tack on more punishment . . '

that makes much more sense as to why some of the laws are listed a felonies and 5years to life in prison...

its was based on minors and specifically relationships involving child, grand-child, sibling (including half-sibling)

then basically after that Under the Incest Act 1908, intercourse between a man and a woman he knows to be his grand-daughter, daughter, sister (including half-sister) or mother is illegal.
Consent is irrelevant. A woman over the age of sexual consent may still not permit a man she knows to be her father, brother or grandfather or son to have sexual intercourse with her.
So it seems while the laws grew in scope the punishment stayed the same

again, i personally think its gross but i dont think there should be laws against it for consenting adults, theres no rationally legal reason for it. Especially none to put consenting adult cousins away for 25 years when many other felons get less . .

just a weird thing . . id guess probably left over from across the pond to where at one time incest was huge.

Agreed. When it comes to establishing whether something should be illegal, rather than examining my own sense of revulsion at the topic, I try to look at it from a perspective of: "What business do I have dictating to another person that I have the authority to limit their behavior by force?"

This thread is a great example of how people see laws as a limitless opportunity to reshape the world according to what they want it to be, rather than solely as a last resort to protect the basic human rights of everyone.

With current child sex abuse laws and statutory rape, it sounds like incest laws are obsolete. (In America, at least.)

Well, I think "unpalatable" is a very generous term you're using there. But, no, my personal preference or disgust has nothing to do with this. Incest is a societal taboo, almost universally and throughout time, on the same level that murder and rape are societal taboos. Actually, more so - on the level of bestiality and necrophilia.

As I write this, I realize that I'm ill equipped to explain this - to be honest, I've never given it much thought, I never expected to be in a debate regarding the validity of incest. You could win this through shock value alone. I could talk about psychological impacts, rape statistics, the dynamics of power within a family structure, the risks presented by opening this up...there is a pile of stuff I could throw at it, but honestly, for me, it's knowing it's wrong in the same way that knowing murder or rape or bestiality or necrophilia is wrong. It's an instinctual reaction, and one that is inherent in the vast majority of people, irrespective of any other factor or variable.

Honestly, I wish I hadn't entered this thread, due to the number of times I've written, deleted, and rewritten in this response alone. The best I can do is say that I wouldn't go out of my way to make it illegal if it were legal...but I wouldn't support moving it from an illegal to legal status in the slightest.

Incest should be banned everywhere. The problem is how to catch them in the act,obviously you can't. liberal/Demos will look the other way as long as the "result" will vote Demo.

There should be more of them.
