i think this sets a very dangerous precedent.

however i could say i could see where this might be rape. she gave consent to kyle not this women.

If my name is Bill, and I'm a $20,000 a year fast food employee, but I tell a girl my name is Steve and I make $120,000 a year as a test pilot for Boeing, and then we have sex four or five times before she finds out my true identity, did I rape her?

not the same thing. rape is done by a person not the things they have.
Rape by deception is a law actually.

it varies by state. yes if your name is bill and you say your name is steve then yes that would fall under the catagory.


and actually yes given your scenerio depending on where you are at you could be charged with rape by deception.

yes she was stupid but i think you should have to be honest about your gender when asking for sex so sentence well deserved
 
I have no idea why you expect that a blindfolded woman would necessarily be able to discern a penis from a dildo.

All penises are unique, and many dildos are modeled after real penises.

The one, and only reason there was any fraud was due to the "victim" agreeing to wear a blindfold each and every time she met, and had sex with the accused.

Seems to me that the 'victim' got all the benefit if she kept coming back for more. What jollies does somebody get who is wearing the strap on though. . . .? Bizarre? Yep. Definitely. Risky, even sick? Absolutely. But a criminal act? I don't see it.

I find this thread VERY interesting, when i get home and have time im going to dive into it.
right now with the little I know "Crime" is a hard pill to swallow . . . . 6 years seems like an IMPOSSIBLE pill to swallow but maybe theres info I dont know.

If the news accounts are to be believed, the victim established a romantic online relationship with the person she beleieved to be a man and the man cast himself in a sympathetic light as being disfigured and that was the only way he could be intimate with another...if she couldnt see him.

When you realize the number of people that get scammed online, the story isnt that far fetched.

Especially if her best friend is telling you what a great deal it is and how you should trust the guy and how lucky she is.
 
I think these young British girls in their 20s were heavily influenced by Fifty Shades of Grey by British author E. L. James. The victims were deceived by a woman who created a fake Facebook profile, pretending a half Filipino boy. Usually, male perpetrators get 6 years in prison for committing a sexual crime, which was why she received the same sentence.
 
So i have read like 6 articles on this now. Some interesting things are she was already tried for this, found guilty then got off on appeal.


The complainant agreed to demands for her to wear a blindfold at all times during up to 15 sexual encounters and while watching television, going on a car journey and even sunbathing.
Newland denied concealing her true identity and claimed both women were gay and struggling with their sexuality when they met and had sex, with her as Kye, during role-play.

The defendant spent 'hundreds' of hours talking on the telephone to her friend as Kye telling her 'emotionally vulnerable' victim 'he' was undergoing treatment for cancer and was paranoid about his physical appearance.

Yes this gets more and more weird, I say this gets appealed yet again and she will get off again. Theres just no way IMO to ever call this a real crime with all that info. WAY TO MUCH reasonable doubt IMO.

Also I have talked about this with about 6 women now and none of them believe its possible to be fooled that much/many times.

If these two were TOTAL strangers and the set up was very large with no shady back ground stories I may be able to think its worthy of a "crime" not sure about 6 year crime but maybe a crime.
 
If this had been a guy tricking a guy, some of the people defending the assault would be throwing a fit and demanding the death penalty.
