Obama immigration order temporarily halted by Texas judge - CNN.com

A federal judge in Texas has temporarily blocked President Barack Obama's executive action on immigration, which has drawn opposition from 26 states across the nation.

United States District Judge Andrew Hanen ruled late Monday night to block executive actions Obama took late last year to shield as many as 5 million undocumented immigrants from deportation. In delaying the ruling, Hanen halted Obama's executive action, ruling that the administration had failed to comply with the Administrative Procedure Act, which calls for the White House to afford a longer notification and comment period before taking action.

The White House said in a statement early Tuesday that Obama's actions "are well within his legal authority" and that the Justice Department has indicated "that it will appeal that decision".

"The district court's decision wrongly prevents these lawful, commonsense policies from taking effect," the White House said in a statement. "The Supreme Court and Congress have made clear that the federal government can set priorities in enforcing our immigration laws — which is exactly what the President did when he announced commonsense policies to help fix our broken immigration system."

If you want to suggest Obama is a dictator and he can do what he wants then so be it. However his policies changed the law by allowing illegals benefits reserved for US Citizens. This he does not have the power to do... unless of course you say he has dictatorial powers.

It would have been negligent of the judge NOT to issue an injunction.

I agree however this could be avoided if Congress would do immigration reform.

First, build a fence and protect the border.

Second, immigrants should have a path to citizenship, including an application filed while in their home country, in person and if approved, entry into the county through legal entry points.

If they don't pass a background check and are denied access, electrify the fence.

Simple as that.
 
One can only hope that executive decisions to carve out large exception pools to standing laws will be declared unconstitutional. If each administration's executive decides to enforce the same laws differently then why bother to pretend to have equal protection of the law?

The Whitehouse (democrats) win regardless of the outcome. They're positioned themselves has the party that stands with the fast-growing and largest minority group in the America. One way or another they will greatly influence election outcomes sooner or later.

I do not know if the federal judge's ruling will withstand the appeal. I am sure Obama will shop the case to a pro-illegal judge in some other part of the country and who knows what percentage of the judges are pro-illegals in the appeals court and supreme court.

Immigration reform is nothing more than code for lets give amnesty(legal status, pathway to citizenship or some other paper coated term for amnesty) to people who took a **** on our sovereignty with hollow promises of enforcement. Real immigration reform is preventing illegals from using government services for themselves and their kids.Real immigration reform is prevent illegals from opening bank accounts, using money wiring services and check cashing services. Real immigration reform is mandating e-verify for every employer,contractor and sub-contractor. Real immigration reform is repealing part of the immigration nationality act of 1965 that allows for the chain migration of relatives other than spouse or minor children. Real immigration reform is sticking scum who hire illegals into prison and making them subject to asset seizure of forfeiture just like other criminals who profit form illegal activities. Real immigration reform is cracking down on sanctuary states and arresting elected officials in those states for encouraging people to come in and stay in this country illegally.Real immigration reform is making illegal entry into the US a felony instead of a misdemeanor for the first offense. Real immigration reform is making residing in the US illegally a felony.Real immigration is cutting off visas to countries we have the most illegal immigration problems with.

The enforcement first before granting amnesty is a con game by pro-illegals who pretend to be against illegal immigration.Because once these 12-20 million plus illegals have the amnesty there is nothing stopping another Obama,Bush or some other pro-illegal from yanking enforcement.This amounts to a bully who promises to always be nice if the nerd gives the bully his birthday cake.Because once the cake is gone the bully has no reason to leave the nerd alone.

Obama's executive action was delayed on a procedural technicality. The ruling says nothing about the EO being unconstitutional. The WH is appealing to fifth circuit court in New Orleans. Who knows how long that will take but in the meantime...an extended comment period could still take place (as if a year wasn't long enough) and when the appeal is upheld the EO could be implemented.....unless congress passes immigration reform.

No, the Judges decision will not withstand an appeal.
 
I'm all for immigration reform. A few reasons:

1. Most Hispanic illegals are Christians.
2. Those illegal Christians are not having abortions, therefore producing Christian families.
3. The fastest growing religion in America, and most places, is Islam.
4. Look at what's taking place in Europe. With the rise in anti-semitism towards Jews and the love for Islamic rights it's clear that it's fast becoming an Islamic state.
5. More Christians means help in putting a stop to the rise of that hate filled religion.
6. Cheap labor keeps cost down.
