I do agree with you that he should resign. I'm sorry if I kinda over politicized it :3oops:

no worries. i seriously did not even notice if his politics were mentioned.

I'm the only 'No' vote. D'oh!

He's retiring from the bench at the end of this year. He's been a club member since 1978. He tried and sponsored a black man for membership in the past. He had written to the club about member diversity in the past. He seems like a good egg.

The rotten eggs will die out over time and the club will be opened to everyone (that can afford the dues) in the near future. Hopefully the retired judge will get to see this in his lifetime.

No he should not resign

I wouldn't join that club though

Just out of curiosity...what is the concern? Does his membership impact his role as a federal judge?

yes. it conveys the appearance of partiality

To who and based on what? Would you have said the judge who ruled on gay marriage in California should have stepped down or at least recused himself?

What about a judge with ties to groups like...say...La Raza? Or as someone else mentioned the Boy Scouts. Has there been any indicators of judicial impropriety or is it just because people disagree with it and think it looks bad. Im guessing there are at least a few congressmen and judge types that are members of...say Augusta National.

To who and based on what?
to anyone interested in finding out that he voluntarily participates as a member of an exlusive club which engages in discrimination
especially against women

were i to bring a title VII gender discrimination cased before the court in his jurisdiction i would seek his recusal based on his club membership

Would you have said the judge who ruled on gay marriage in California should have stepped down or at least recused himself?
not acquainted with it, nor interested enough to become familiar

The code forbids federal judges from being members of clubs that discriminate based on race or gender.

this is why. if someone wants to argue about other instances, fine, but in this case, the judge is violating the code.

And seeking his recussal from that specific case would be an appropriate recourse for a participant in the trial, as would ANY case where the judge had a connection that might indicate bias. Good point. Does that mean they should be disbarred or forced to end associations where there are no indications of impact?

and they are wrong.

In your opinion. And in the opinion of 8 dissenting judges. But apparently 10 see things differently than the 8...and you.

So...we are moving for congress to disband the Congressional Black Caucus pretty quick too I'm guessing...

it's distressing that not everybody knows i'm right.

Hokey schmoke...who knew there were so many Womens Organizations out there. And minority specific organizations. Well...that settles it. Shut em all down....

I think I married your twin sister...Mrs Right. First name...Always...

;)

to many of us, such dissolution would enhance the former members' credibility

And some Judges are members of organizations that believe in YHWH:shrug:

Right...so lets eliminate anyone from public service if they have any specific bias or affiliations with any group that others might disagree with or find conflicting to their OWn personal biases instead of examining if there is ACTUAL bias involved. Better yet...we can snatch babies at birth...send them off to some private island and raise them to be gender and race neutral.

Its funny though...a quick search and I cant find too many threads calling for it...or news stories...or...well...ANYTHING. Seems it really doesnt matter for some reason.

It's a violation of judicial ethics.

Again...10 judges vs 8 disagree with you. I know...I know...you went to a different law school and belong to a different bar so you know better too...
