Hmm you do know that first the wiki-leaker is Australian and hence cant be charged for treason in the US.

Now the US citizen that gave him the material could be, but guessing that he is white and in the military, then that wont happen. Funny how all the anger has been thrown the Australian but not a peep on the US solider that gave him the information.

Good luck in proving he is a spy. For one he was not in the US when the material was stolen by a US citizen. In fact I doubt he has been in the US for a very long time if at all, since he is rather paranoid type person and only visits countries where he cant be arrested and sued for the leaks his site has published.

So how can he be a spy if he was not in the US when the material was given to him?

couldn't tell you about how that matters at all; except that military justice offers him much less of an ability to skip off scott free than civilian justice does. frankly, i hope he is killed as well.

Treason was specifically defined in the United States Constitution, the only crime so defined. Article III Section 3 delineates treason as follows:

Treason against the United States, shall consist only in levying War against them, or in adhering to their Enemies, giving them Aid and Comfort. No Person shall be convicted of Treason unless on the Testimony of two Witnesses to the same overt Act, or on Confession in open Court.

Seems more probable he'll be convicted of espionage. Execution? I seriously doubt it. We aren't even formally at war.

If you are talking about the Americans who leaked classified info to wiki-leaks then yes they should be executed for treason,those from other countries should be executed for treason by their countries whom they leaked classified info from. If you are talking about the guy who runs wiki-leaks, I think at most he can be treated as a spy and punished accordingly since he is not a US citizen. The the only people would be able to charge him with treason is Australia (assuming he has classified Australian intel on wiki-leaks). I assume you mean the American soldier who leaked classified info so I answered yes to the poll question.

But yes, if this leaker is found guilty of treason in a time of war, the punishment is death.

It would be more useful to keep him alive in case he leaked other info that we don't know about yet. Also, he's pretty young and who knows what forces were manipulating him. In any case, I hope he has a good defense.

But I do understand the primitive American need for vengeance and retribution, so he will likely die a needless death if populism has anything to say about it. :shrug:

As if you are so enlightened, please. Where is your enlightened compassion for the folk who are at greater risk due to this persons treason. There is nothing "primitive" here.

I have no use for the guy, I hope he never sees the light of day again, but executing him seems to be going a bit far to my mind.

He wasn't giving classified documents to the enemy or providing them aid and comfort, he was giving them to a neutral third party.

Considering the fact this neutral 3rd party is showing it to the entire world he is indeed giving classified documents to the enemy. The soldier in question knowingly gave the info to a middleman who gave it to the enemy. Giving classified info to a middleman is as worse as directly giving it to the enemy.

He's not merely a spy... he swore to defend and protect this country and instead sold us out and jeopardized our security. That's betrayal, which is treason.

I think he should be made an example of and executed. If not now... when?

Giving it to the enemy and giving to the world aren't identical. If the enemy has an exclusive, then they know information we believe is hidden and can use it that much effectively against us. If it is given to the world, we have a mutual awareness and can develop counter measures.

One signals that the U.S. soldier wants primary objective is to hurt the United States, which is treason. The other doesn't necessarily imply a desire to hurt the United States because he might believe it is overall in our best interests for the public to have the information.
