Should the man have been arrested for being naked in his kitchen?

The cops should be taught how to think...yes, I know this cannot be taught.
The 5 cops should be laid off, if they have nothing better to do.
The woman should be given a warning for trespassing.
This whole thing is an absurdity; maybe its just a test or a survey of sorts??

Considering the audacity of the woman she should be fined.Screw a warning should be something given if the cops were the ones who caught the woman in the process of trespassing. The fact she called the cops to report something she seen someone do in their privacy of their home while she was in the process of trespassing is deserving of a ticket. The guy should fight the charges or fines and sue the woman.
 
She does have an extreme amount of nerve to do this. It's absolutely beyond absurd. It's akin to the burgler who gets injured while burglerizing a house, so he sues.

I wanted to be try and devil’s advocate this fully since everyone is disagreeing but I just can’t do it.

What I will say is I understand the need for the laws a bit. Yes, we’re a bit uppity about Nudity but the fact of the matter is the majority of Americans do find being exposed to naked people when not expected it is offensive and for parents, harmful to their children, and fine, so be it. I have no issue with public decency laws in regards to being naked in public. Likewise, I don’t mind laws in regards to it in your house.

However, the intent of the law and reason needs to factor in.

If a person has a large bay window facing the sidewalk and routinely does his afternoon exercises in the buff right around the time kids are getting off the school bus near his house, and multiple people report this to the cops, I’d have no problem with something being done. Yes, its your house, but doing naked jumping jacks so your junk is flying all around directly in front of a window that’s clearly visible from the public is a no go.

HOWEVER, if there’s no reasonable evidence to believe that you’re doing this on purpose (directly facing public, no use of blinds or curtains, repeated action after complaints, middle of the night, etc) and it’s something innocent like rolling out of bed naked and grilling up a 3 AM snack in your kitchen whose window isn’t visible from public views then in no way should anything be done.

There’s got to be some common sense here. This is guy is not the same as a guy standing at his window that’s visible from the sidewalk pleasuring himself with the blinds fully pulled back.

good point. i personally know of a situation where what you described happened. a convicted flasher stood in a window and exposed himself to boys coming home form school. he was arrested and convicted yet again.

This video from Fox News tells the story. He was spotted through his kitchen window at 5 AM making coffee in the buff by a woman who was cutting across his lawn with her child. She called the police and 5 cops barged in his house and found him in his bedroom and arrested him. He's facing charges for indecent exposure.

He should not be arrested for being in his kitchen naked - he should be arrested for not being in MY kitchen naked:2razz:

So now we have two sides to the story, essentially a case of he said, she said. The police are checking to see if there have been any other complaints. If they find that this guy has been reported for the same thing in the past, then I'd be inclined to give more credibility to the woman's side of things. If this is the first time, then I don't see how the state would be able to prove intent on the man's part, which is crucial to getting a conviction.
 
That's the point though, she was not in public, she was tresspassing on his property.
If he could be seen from the street, ok there might be an issue there. But if you had to be tresspassing to see him, then ****... you might as well arrest someone for being nude in the tub, after all if someone broke into their house they might see them nude. :roll:





Now there's a good point. Why do I suspect she had a grudge against this man and was snooping?

There's this apocryphal story about a little old lady who called the cops. "Officer, those people next door are always parading around in the nude! Something should be done!"
Cop: "Okay, Lady, you show me where you saw them, and if I can see them too I'll arrest 'em."
The little old lady leads him outside, through a gap into the hedge into the neighbor's yard, and up to a closed window. "Right here, Officer!"

If it can be proven that he could be seen from the street, then the DA will have a case. I think it should be dropped though, the guy really didn't intend for anyone to see him. Also, his treatment by the police was absurd and cruel.

It should, and if it was during the time when kids and their parents would likely be out walking to school, it shouldn't be difficult to find others who saw him if his intent was to expose himself to the public. I just hope that if things unfolded the way he described them that he can get his reputation back.

Police: Others May Have Seen Naked Man

Police wouldn't release the incident report or the name of the mother who filed the complaint. FOX 5 has learned she is a respected member of the community, and just happens to be the wife of a Fairfax County Police officer.

First, why wouldn't they release the report or the name of the mother?

Second, it seems to me that this is a witch hunt if the mother is the wife of a cop. I'm not saying that this is always the case. It just seems awefully suspicious to me in this case.

And anyone ever notice that if a woman reports seeing a guy naked in his home that the guy is investigated and yet if a guy sees a woman naked in her home the guy is arrested for being a peeping tom?
