This is the reason the original prosecutor only charged 3rd degree murder, and manslaughter,
he felt that he could prove the elements of those beyond a reasonable doubt.
1st degree murder, would be a much higher bar to reach.
If Chauvin were convicted of both, he could get 40 years, before the Feds try him on civil rights violations.

I understand they bumped it up to 2nd today.

If police officer Derek Chauvin, the man who kneeled on Floyd George's neck is acquitted, how bad do you think it will get?

There is no way that he is getting off... the video is as clear and cut as I have ever seen.

I hope that the prosecutor includes 3rd Degree Murder still as a fall back though...

I would have gone for reckless homicide as the back up.

It is good to note that prior to the video being released it had been declared a "good kill".

Just like in the case of the guys who chased Aubrey down and killed him when he refused to submit.

I wouldn't have either.

Just look at those guys.

You know they're the type who keep geeks in their basements so they can get their gay on in secret.

They’re making so many amateur mistakes I’m starting to wonder if they’re doing it on purpose to throw the case. Some knucklehead went on TV today to say they’re charging him with murder two now because “that’s what the public wants.”

Overcharging is the way to get acquittals. All 3 of "Aiding Murder" charges are absurd.

When are police in Democratic run cities going to realize that what they should do is absolutely nothing. Arrest no one. Do nothing. For any call of a crime, always be occupied doing something else. When was the last time you heard of ANY police officer in a Democratic run city in the police union getting fired for doing nothing?

In this instance, if those 4 officers had not shown up for an hour and then did nothing but write a report, everything would have gone fine for them.

Yeah, every time cops are clearly on video beating or killing a black man, it's just too clear and cut, and they go to jail....

Cops get away with murder all the time. Which is what I don't get about the racists out there. Bad cops don't just kill unarmed black men. They kill unarmed white men. They kill unarmed Hispanic men. Sometimes, they kill unarmed women. Bad cops aren't all racists, some are just sociopaths and indiscriminate about their brutality. However, if you combat police brutality against unarmed black men, which are disproportionately victims of it, you combat it against everyone.

Agreed... bad cops are bad to everyone... that is why my story about being 'abused" by white cops as a white guy is relevant. The bad cop just picked on whoever was in reach so that he could satisfy his inner bully.

I remember two guys from high-school. Angry socially inept assholes. A few years after high-school who do I see as cops in our town? The two assholes. I thought... 'figures'

I agree with this, but racial bias is often a big factor as well.
 
There is usually a scale of charges for the jury to choose from.
From what I read, the difference between third degree and second degree is one of intent. If Officer Chauvin only intended to harm and demean Floyd George, that is third degree. If Chauvin ever thought FG was dying, it becomes 2nd degree, because there was no act to try to preserve life. A lawyer could explain better, I am sure.

Regardless, intent is going to be an issue for the jury--did Chauvin intend to harm or did he intend to kill.

He’ll either be acquitted or win on appeal if it’s 2nd degree murder. The video doesn’t support it, their comments in the media don’t support it, and the autopsy report saying he essentially died of a heart attack with fentanyl and meth in his system just disintegrates any shred of a 3rd degree case they think they have.

He is clearly choking him into unconsciousness... other medical conditions or drug use is irrelevant.

They’re extremely relevant. The autopsy concluded he died of a heart attack not of asphyxiation.
 
Mr. Floyd will get justice. We witnessed his death, heard his pleas, and saw the dead eyes of his killer and accomplices.
