Meghan Murphy's tweet: Hateful conduct or public warning?

The final straw for Twitter was a tweet in which Murphy referred to a transgender activist, Jessica Yaniv, as “him.” Murphy’s tweet included a screenshot of a review that Yaniv posted for a waxing salon, under the previous name, “Jonathan Yaniv,” which is still listed on Yaniv’s Twitter profile.

“In the past year, Yaniv has filed 16 different human rights complaints against female estheticians from across Canada for refusing to perform Brazilian waxes on Yaniv due to Yaniv having male genitalia,” Murphy’s lawyers wrote in court documents reviewed by TheDCNF.

In an email to TheDCNF, Yaniv called it “totally untrue that ALL of the complaints are involving Brazilian waxing and that they are women’“working from their homes’ because as such, many of these are retail salons. Also, she, nor the lawyer knows about my genitalia, nor is it applicable because as you know, I am legally a female.”

Today, the Superior Court of San Francisco dismissed a user’s lawsuit against Twitter, effectively ruling that the social media giant may break its promises to users or advertisers with impunity. The court’s overbroad interpretation of Communications Decency Act Section 230 gives internet platforms sweeping immunity from suit, even for violating their own contracts and flouting their own promises to users and advertisers. We intend to appeal this ruling, and will continue to seek to protect the rights of consumers in the social media world….

In rejecting Twitter’s anti-SLAPP action pursuant to its public interest exception, the Court joins a growing chorus recognizing the centrality of social media to public discourse—and the importance to the public of adjudicating legal claims against the major social media platforms.

It(twitter) then banned her permanently after she asserted that transgender women in Canada formerly named Jonathan Yaniv is"the man responsible for trying to extort money from estheticians who refuse to give him a brazilian bikini wax," asked why the media and courts are "protecting this guy's identity."

She actually did nothing wrong, because one could probably dig up about 20 or so post from other twitter users, though less prominent ones. Who got to keep their accounts and probably said far more abhorrent things.

My offense was "hate speech." Trying to figure out how that was hate speech, as it didn't cover his race, gender, sexual orientation, etc.

That doesn't sound like hateful conduct to me, it sounds like she was trying to warn the public.

Why the f*** is the court/media protecting this guy’s identity either way? The women he targeted don’t get that luxury.”

Murphy was banned from Twitter after she tweeted in response to her earlier question: “Yeah it’s him,” which was classified as “hate speech.” Twitter has a policy against intentionally misgendering people. Murphy had previously been suspended for statements that called transgender women “men.”
