For some reason, 20 and 30 somethings appear to have a mental block against comprehending how easily information (and pictures) get around the Internet...

Please, I realize this may seem hard for you to believe, but it's fairly normal for modern couples to send sexy text messages. Obviously, if she was dating this guy she trusted him. That may have been a mistake, and she'll have to pay for that with the embarrassment of having that photograph in the public domain, but that shouldn't cost her a job.

A Teacher Is Fired Over a Topless Selfie, Stirring a Debate Over Gender Equity - The New York Times

Despite this being framed as a 'gender equality issue' by the plaintiff's lawyer, I see it as an attempt to shakedown a school district for a large sum of money. We're constantly told today that employers have the right to fire employees if they engage in conduct outside of the parameters of acceptable behavior recognized by the employer. This reasoning has been used quite often in recent years, to terminate employment over distasteful social media posts, attending political rallies, and even in cases of supporting the BDS movement.

I say this was Ms Miranda's mistake, and if she wishes to sue somebody for her mistake, she should sue the male teacher who shared the topless picture with students. His behavior was beyond immature and stupid.

Nope. She was on her own time and not on school grounds: would she fired for being out at night drunk on New Year's Eve? Not hardly.

Yes. It is very clear she shouldn't be responsible for her own actions. Hit the taxpayers! Better yet, provide fewer textbooks, fewer paper towels in the restrooms, less pay for teachers, and less school system supplies. That will erase the picture, and the cash will assure she won't feel the sting of being such a bottom feeding moron!

Yes, it's very clear that consenting adults should do as they like with any legal behavior in the privacy of their own homes.

I hope she gets her millions. Snotty school districts should be minding their own business.

It didn't turn into moral turpitude until that kid started flashing it around school! She's not responsible for that.
 
Now I’m not saying this happened, but has any of you conspiracy theorist considered she was in on it and they leaked the photo for a pay day...as teaching became unsatisfactory. Peeps is crazy these days

The genesis was her somewhat naïve notion that a nude picture was a good idea and private. Folks, if you don't want nude photo's of you spread across the internet, it is within your power to prevent it. Just don't take them.

The genesis of all this is a a prudish school board who should just have minded their own business in the first place and left well enough alone to just be forgotten in a couple of days pr so. NOT make themselves look immature and foolish for making such an idiot move on an adult who did nothing wrong.

I think she should be reinstated in her prior teaching position and back pay. Her only sin was that she shared an intimate photograph a man who was either a careless fool or an utter reprobate. This humiliation was a step too far.

She's in the right on this.

I don't know if it's worth $3mil, less than that, or more.

But certainly it was wrong to fire her for something she had no apparent control over.

Was this just an intimate pic shared with her lover or something? And it just got out? Well, that'd rate a 'so what', wouldn't it? I mean **** like that happens on breakups.

If she was passing it around to students, that ranks right up there with the stupid male teacher showing students.

If the argument is that this is some sort of 'gender equality issue' as argued by the plaintiff's lawyer, I'm having a hard time seeing that as being reasonable.
 
I'm certainly not in favor of that photo getting into the hands of a student. I think she was careless in trusting her relationship with another teacher to be solid enough that he would not share the photo. All that said. I don't really have a problem with her suing the school. The decision seems to blame Miranda and not the man who put the photo out in the public. I don't know what Miranda could have done to make sure the picture wasn't released and I bet she told the boyfriend not to show it to anyone. I'm curious as to how the student received the pic? I also think her point that similar pictures of men were not met with the same punishment is well founded. Firing her is a Slippery slope.

When you push that send button it's out there. Some jobs have a more stringent morality requirement than others. And teaching is one of them. Parents have a right to expect a higher standard of conduct than they should require of the guys who, say, pick up their trash. Or even the mechanic who repairs their cars. This is a thing you should know going in; teaching might just require a higher standard of conduct.
 
Yep, pay the lady. Unless it can be proved that she distributed the photo to students, but I'm not seeing anything that suggests that.
