Clarence Thomas, a graduate of Yale Law School, ranks as the most intellectually lazy jurist on the current USSC.

I withhold any definitive judgment and await the disclosure of further information about Dr. Ford's alleged sexual assault claim against Kavanaugh. Let's hope the truth comes out sooner than later!

Your keen insight outed my predilection for Brown Superiority! I admit having had a crush on Thurgood Marshall. I also admit, with regard to Justice Thomas, to doing my own ranking.

While members of one minority seem to dominate the NBA and the WNBA, not all members of that minority play excellent basketball.

Since his views on major legal questions can be idiosyncratic and unlikely to command a majority, he is particularly apt to be assigned the inconsequential and technical majority opinions that the justices call dogs. They often involve routine cases involving taxes, bankruptcy, pensions and patents, in which shared wording, including quotations from statutes and earlier decisions, is particularly common.

Considering our close proximity in age, that you graduated Yale Law, had a two-plus decade career as a federal prosecutor and have indicated you believe if Romney had become POTUS you would have become a Federal Judge, it makes sense you would have more insight than I do into why Daddy Bush nominated Thomas.

The GOP at that time held a majority in the Senate.Thomas had and continues to have a track record of favoring Conservative views. Even today he remains stained by Hill's accusations. He won confirmation by a slim margin... 52 -48.

Does this story by Dr. Ford of alleged teenage sexual assault derail Kavanaugh's confirmation?

On September 4th, Renae created a somewhat similar poll with four choices. At that time I thought Kavanaugh had a lock on enough Senate votes to win confirmation. Last I checked, only Cardinal voted the Senate would not confirm Kavanaugh.

This late breaking development regarding alleged teenage sexual assault has changed my mind. I now agree with Cardinal.

I have provided a simple poll with only two choices:

Vote 'YES' if you expect Kavanaugh to win confirmation.

Vote 'NO' if you do not expect Kavanaugh to win confirmation.
At the moment I think he'll get approved, unless this Christina Ford thing acquires some more substance.
It just doesn't seem to have enough evidence supporting it to stop the confirmation at the moment.

Kavanaugh appears to currently have the likely votes to win confirmation. This 'Rush to Vote' adds further controversy to his likely confirmation. If he becomes the newest jurist on the USSC without Ford testifying, I expect this controversy to haunt him.

since you tend to read what people write and then comment-I will tell you. Bork had been rejected showing the GOP leadership that the senate was no longer deferential to the White House if the WH pick was someone to "controversial". Thurgood Marshall's seat opened up. Mitchell meets with one of the young attorneys from the WH counsel's office -I believe it was Lee Liberman (Now Otis-a professor at Georgetown and a Federalist Society member and Scalia law clerk) or Peter Keisler (also a Fed Society founder) or both, and tells them that the DNC considers the open seat "the black seat" and if an African-American is not nominated, the Senate will deny him or her the seat.

The number of conservative blacks with judicial experience and top drawer degrees was extremely limited. CT was picked because he graduated from Holy Cross, Yale Law (where he was a strong student but not someone in say the same league as Alito or Sotomayor since he wasn't a YLJ editor) and had experience in both government and on the Bench.

when people claim CT's credentials were lower than his contemporaries in terms of an academic record they are right. when people understand Mitchell demanded a black nominee, CT was pretty much at the very top of the list in terms of available candidates.

He can and should be approved. Unless there is some actual substance presented to support the allegations made of an incident which supposedly happened 4 decades ago, then he absolutely should be voted in. This bull**** leftist tactic has to stop.

Make no mistake...I do not discount legitimate reports of rape and/or sexual assault and I literally do not have an opinion on whether or not this incident happened. From a 'justice' perspective the allegations are indefensible. The surrounding circumstances are also just too convenient. Does that mean it DIDNT happen? Nope. But does that mean it DID? Nope. We dont know and anyone that has formed a definitive opinion based on what we know is literally a mindless partisan twat. We DO have a presumption of innocence in this country. It is supposed to prevent peoples lives from being ruined by scurrilous accusations without foundation. The incident in question qualifies.
