Should the FBI investigate allegations against Kavanaugh before Confirmation?
Report would be provided to the Senate Judiciary Committee.

If there are credible allegations that stem from crimes that may have been committed when he was an adult, then sure.
No need to go and dredge up allegations that may or may not be valid from when he was a teen aged kid.

Let the person who never did something stupid as a teen cast the first stone.

I thought the FBI already stated they weren't going to examine the allegations as they are currently stated?

I think the FBI should get a FISA warrant on the woman. Wiretap her and everyone she has had contact with.

f the allegations against him are true, that’s absolutely possible. In fact, a criminal investigation might even be considered plausible at this point under certain circumstances. That’s because the State of Maryland has no statute of limitations for felony sexual assault charges.

The on-point law here is contained in the Maryland Code of Criminal Law at sections 3-303 through 3-312. Now that’s an awful lot of statutory legalese to digest and far too much of a textual task for one law explainer. Suffice to say, the Old Line State has an expansive array of sex crimes for any potential prosecutor to choose from–many of which entail felony criminal liability.

Yeah, I think we should just pass the guy with flying colors without any further investigation.

I think it is important to get the message out that if you plan on sexually assaulting someone, you'd better do it in your formative years so it can't be held against you when you get older. Yeah, that's where this country is at now. The ***** grabbers are in charge.

We also need to know the owner's name of that house where the "crime" happened.
Complicit in under-age drinking and "rape" activities ... even if they weren't present.

i think if you believe some HS kid groping you is so damning that it should overrule 30 years of public service then you should have made a report to someone when it happened.

if this really happened, the "Victim" should be sanctioned because she did a disservice to other women who might have come into contact with this "sexual criminal" and not done anything to prevent additional "assaults"

I think the senate needs to do their due diligence and take off their partisan glasses and do the right thing whatever they feel that may be. No just what the party says or simply to be against the other party. The FBI isn't needed.

You know why teenagers and women do not report this assaults. In particular back then and even up to recent years, where many blame the girl/woman
Sanctioned- what sanctions would you impose?

Now as we just learned Maryland has no Statue of Limitations on sex assault.

If she files a complaint, will the Nomination be halted/withdrawn?
If a complaint is filed, then the FBI would be involved.
The local DA would be under immense pressure to investigate.

Exactly what should happen, but it won't.

It doesn't matter what the outcome of any investigation may be. All that matters is that there are more Republicans than Democrats in Congress, and therefore Kavanaugh will be seated on the SCOTUS. It's really as simple as that. The hearings are just political grandstanding.

The accusations stem from when he was in prepratory school, was he even legally an adult at the time?

Either way, it's probably outside statute of limitations (whether that should be changed is a WHOLE other argument).

No matter when the incident happened, it does say something about Kavanaugh's core character if true.

A SC Justice should have as pristine a history as possible.

30 years ago, in High School, a she said, he said situation with no way to prove anything one way or the other. Why bother unless one wants to score political points? Dredging up something that may or may not have occurred when one was a teenager in my opinion is partisan politics at its best, or worst. Smacks of muck racking to me.

Of course the FBI must investigate these charges and the Committee should have the report in their hands when they hold the public hearing into this matter. To do anything else is to deny members of the Senate all the relevant information they need to properly conduct that public hearing.

What is the other side afraid of the FBI will uncover in an investigation?

What is it exactly you are afraid of the FBI unearthing via a thorough investigation?

Times have changed. He is up for the highest Judicial appointment in the country.

To be clear I don't believe the FBI is investigating me so I have nothing to be afraid of. That would just be stupid. As for why they aren't needed in this case is that there are no criminal charges that even could be brought. There is no chance of it. These senators need to investigate it and vote accordingly with their conscience not their party.

I voted NO.

Actually Maryland does have some statute of limitations for criminal misdemeanors.

According to the reported allegations, the worst it could be would be Fourth Degree Sexual Offense:

(b) Prohibited. -- A person may not engage in: (1) sexual contact with another without the consent of the other;...
(d) Penalty. --
(1) Except as provided in paragraph (2) of this subsection, a person who violates this section is guilty of the misdemeanor of sexual offense in the fourth degree and on conviction is subject to imprisonment not exceeding 1 year or a fine not exceeding $ 1,000 or both.

https://law.justia.com/codes/maryland/2017/criminal-law/title-3/subtitle-3/section-3-308/

(Paragraph 2 refers to repeat offenses.) There are also specific sections concerning persons in authority (which do not include same/close in age minors).

Per Maryland Statute of Limitation guidelines:

MD. CODE, CRIM. LAW § 3-308 Sexual offense, fourth degree Misdemeanor: In principle, within one year after commission of the offense. For prosecution of sexual offense in the fourth degree by offender in position of authority (§ 3-308(c)), within 3 years after commission of the offense.

https://www.rainn.org/pdf-files-and...esources/2009-Statutes/09MarylandStatutes.pdf

So NO, Kavanaugh is not facing any criminal charges.

What are you afraid of the FBI finding regarding Kavanaugh and the allegations in this incident? It seems like your attitude and that of others on your side seems to be like the old Sgt. Schultz on HOGANS HEROES..... "I see nothing, I know nothing".
