This is not a process discussion, nor is it a discussion for examining which things he's already done that qualify as crimes and/or impeachable offenses. The poll assumes four things:

1)that the Special Counsel and/or other ongoing Federal and State investigations have conclusively determined that Trump committed crimes.
2)that the crimes are serious (i.e. not jaywalking or returning a late library book).
3)that the necessary steps to get to an indictment have been followed properly and legally (which is why I say this is not a process discussion).
4)that 1, 2 and 3 have resulted in an early termination to Trump's service as President.

Therefore...should Trump go to prison? One possible suggestion for approaching the question would be whether or not sending him to prison would be good for the nation.

Is the crime jaywalking?

I need to know the crime before deciding on punishment, me being all civilized and all, unlike some.

I also need proof.

If he's guilty of a crime that normally requires prison time, absolutely. For some reason many Trump supporters seem to think that he should be legally immune to prosecution for violating our laws just because they adore him. Doesn't work that way, guys, we all live under these laws and your boy doesn't get a free pass.

Based on this four question test, yes, Trump, along with anyone who has engaged in 1 through 4.

Trump is not above the law, no matter how much he and his base thinks he is.

If it's a crime where prison is a normal sentence, how is this even a question?

Why do people keep speculating on "what if's?" :doh

What if a solar flare happened two days from now, would you survive it?

What if there were an actual Megalodon swimming around in the Marianas Trench, would it come up and eat you?

No one should "got to prison" unless they have been given a fair and impartial trial in a court of legal jurisdiction (not the court of public opinion).

Speculation with your list of requirements is meaningless, unless and until someone is actually convicted in such a court of law.

If convicted it will be up to the Judge to determine sentencing dependent on the penalties pertaining to conviction.

I don't think anyone should get any special treatment, do you?

Let the "What about Hillary?" comments begin.

You tell the rest of us not to engage in speculation (in a hypothetical scenario, no less), then go on to speculate from my hypothetical scenario that he must have been convicted in the court of public opinion. The best I can gather is that you don't know what "speculation" means.

If convicted it will be up to the Judge to determine sentencing dependent on the penalties pertaining to conviction.

I quite specifically stated that this is not a "process" discussion. If you're a legal expert because you follow Popehat or Renato Mariotti on Twitter, save it for another thread.

DP can't convict anyone, only our courts. I've never understood you hardcore Trump supporters suggesting the FBI should ignore the crimes they uncover in the administration. Protocol is being followed and people will be convicted only after put on trial.

He should face the same consequences & sentencing of any other citizen in relation to the crime.

In this hypothetical scenario, given those 4 assumptions, then yes he should do some time. I have no issue with sending former presidents to prison if the crime is serious enough. What is worse for the country is allowing our leaders to get away with crimes.

.

Those actually sound like fun thread topics. :)

Cardinal, you forgot the obligatory "rutabaga" option. Are you feeling alright?

My polls are rutabaga free. They're also alcohol free, drug free and fat free. But I always make sure they have the most avant-garde and edgy church choir music. Dancing is permitted, but there is absolutely no contact between members of the opposite sex.

Gee, thanks.

What about polls about alcohol or drugs? Or rutabagas, for that matter?

I was wondering if it would even be possible for our country to have a President Park moment of our own. A genuine problem is that I can't even imagine it happening. I assume that a President is going to get away with major crimes, and that's not good for citizens in a democracy and a "nation of laws." I think the vast majority of us believe that even if all four components in my hypothetical scenario are met, Trump will not do prison time.

Seoul, South Korea (CNN)A South Korean court has found former President Park Geun-hye guilty on multiple counts of abuse of power, bribery and coercion and sentenced her to 24 years in prison.

Park's conviction brings to close a corruption scandal which gripped South Korea, upending the country's politics and implicating some of the country's most powerful figures.

To answer the poll seriously, in the hypothetical situation laid out, it would be highly improbable for Trump not to deserve prison time. There's likely some corner case possibility that he could get off without prison time for a serious crime if he took a very sweet plea deal, but that's such an excercise in minute theoretical factors that I can't see any value in discussing it.

As for it's effect on the nation, rule of law is already abused enough when it comes to politicians and rich people - whatever the social ramifications of sending a guilty President to prison might be, it's worse to let a guilty President get to skip prison time to appease the mob.
