We need to decide whether we subject prisoners to harsh conditions as a "deterrent" or not. I can't accept that this judge's words are any worse than solitary confinement or capital punishment.

I don't either. I consider the judge's words inappropriate and undignified. Ill-advised, but not life changing, certainly. I consider things like Arpaio-like stuff to be borderline criminal, if not outright criminal.
