Hunter accidentally kills another hunter; should she face criminal charges?

Should she face criminal charges?

It's not often that I'm at a loss for words.

Sorry, I phrased that poorly. I just mean it's kind of an assumption of the risk type thing, like a race car driver getting killed during a race.

See -- we need more details to the story. If he was hunting too, he should've had reflective clothing on. If he did, she should've seen it.

short of him dressing up in a pig outfit and yelling sooooweeeeee, the blame is on her-period.

I don't know. If you're going out to shoot something yourself, do you really have much to complain about when it's you who gets shot?

Err, yes.

I voted no. I kinda figure that's a risk you assume.

Lol...no it isn't. Most of hunting isn't like the movies where people are shooting at everything that moves. There is clear etiquette and rules for hunting, one of them being identifying your target before shooting it. Also, to make sure you have a good backstop. This is negligent and would be manslaughter.

It's like someone driving recklessly on the road and killing someone else and saying, "I kinda figure that's the risk you assume."

I'll remember that, should fate ever take you my way and have you shooting into my land.

Heck, now that I have your official permission, you can do all of it standing upright.:2razz:

If I'm out shooting into your land, it can only mean the zombie apocalypse has started. I don't hunt. I do shoot trap on occasion though, and when I do, I know the potential for an accident is there.

Still needs investigation - it's not open & shut

More info - but it's the Daily Mail:

@ South Carolina man shot dead after being mistaken for hog | Daily Mail Online

"Young was apparently kneeling when he took a fatal bullet to the head
...
"The scope on the woman's gun recorded the shot and shows the outline"

(More @ the URL)

Yah. It still needs a thorough investigation, my opinion.

Was the victim on all fours before or after she shot him from the next property?
according to her: before. Afterwards (by general logic): definitely
Can you see reflective clothing through a night sight/image intensifier
If there's enough light to see the target, yes.

If there's no light at all you see not a darned thing.

But even if your scope provides the light (IR), yes.

I doubt she had an IR scope though, or a thermal imaging scope.

I don't live in Haiti

Yeah, not long ago that stuff started raining onto my porch. Mind you, with the ballistic curve it had already travelled I could by then slap it out of the air with my hands.

Didn't stop me from having a word with the silly buggers though. Make that plural.

Of course they were shooting real birds where they shouldn't have been, trap shooting ranges are usually set in such a direction that nothing gets near any dwelling, not even on the fall.

Dialing in

The Daily Mail (see above) says she had an ATN thermal night vision scope. (Looking @ their site, these are pricey devices.)

This is why women shouldn't be allowed to own guns.
or drive cars.

Exception to that rule: happily petitioning the Saudi government to either let them drive (ferrchrissake) or allow then to have guns.;)

I see (no pun intended).

Well, if that was the case, bloody waste of money with her.

She probably thought she did know what she was shooting at.
Rule #1 (in my best de Niro voice) if there's any doubt, there isn't any doubt.

Which of course in his case means "shoot" but with her (as with me) if should/would have meant "don't".

not like you can in normal light but reflective clothing is noticeable

Most boar hunters use boar calls as well. If he was on all fours and using a boar call it would make more sense.
Still a bad shot. It all depends on what he was wearing etc.

I always wore my orange while in the woods.

OK, I understand that.

It's not, however, even remotely that fallacy.

The Texas Sharpshooter has to do with data points, and how they're misapplied and given unjustifiable statistical weight.

I think, perhaps, in this case, it could be the as-yet-unrecognized "South Carolina Idiot Tard-Shooter Fallacy".

I stand corrected.

This is my issue, if she couldn't accurately distinguish what her target was then she had no business pulling the trigger and to me signifies negligence. For all she knew it could have been someone's dog.

Oh, I agree she shouldn't have taken the shot.

But I still wonder why thw other hunter was on all fours. I have done a little hunting and don't remember being on all fours except to get the rifle out of its case.

I voted yes.

At the very least involuntary manslaughter.

She probably thought she did know what she was shooting at.

Lots of people shoot at things they can't see very well. Usually it's not a person. Occasionally it is, which is why they should prosecute. People need to be more careful. I shot a deer once between sunset and dark (but closer to dark). It was a lot closer than I thought and turned out to be bambi. If you can't see it well enough to be certain, pass on it (unless it's shooting at you).
