Ok, technically, on that we agree. They can't necessarily take it, but they can... and have... make the consequences so big that most people won't consider fighting it. It's easy to sit at a computer and say it's not legal, it's quite another to actually lose your DL and be faced with a serious downgrade in life.

Actions have consequences. You have to decide what's more important, your license or your freedom.
 
Which would you choose? If, extremely unlikely as it may be, you were ever in a situation to choose, of course.

Freedom, of course. But then again, I don't touch my phone in the car, period so I would never get pulled over. Looking like you're committing a crime is a choice as well. Don't do that.

Which one is freedom? Freedom to decline the request, or the freedom to easily travel via driving?

How does using your phone have anything to do with driving?
 
Problem is, once something becomes law it is incredibly difficult to repeal. Even tweaking takes time, sometimes a lot of time.

Goes for pretty much anything, not just here.

Very true but again as long as its applied like I described I have no issues with it. If not then I do have issues with it, like many things.

I drove without a license for years.
