Re: Should Trump be allowed to appoint a SC Justice in the final year of his presiden
Agreed. The quoted "Biden Rule" was abused and never actually applied. Garland should have got his up or down vote. And now, so should Gorsuch. I have a few problems with him, but he is replacing Scallia so it seems as close as we could get to a wash. And there is some reason to believe he may be a thorn in conservative sides much as Roberts has been on some rulings.
I think any president should be able to nominate the SCOTUS justice he pleases and that nominee deserves a vote in the senate. I think McConnell not bringing Garland's nomination up for a vote was about as wrong as wrong could be. The same thing goes for Chuck Schumer when he stated the senate would take up any of Bush's nominees if a SCOTUS position became open in his last year.
The thing is with 54 senators, the Republicans could have voted Garland down if they had a mind too. Garland deserved a vote. The same holds true in my opinion with Trump if a vacancy occurs in his last year. The problem is partisan politics, polarization in Washington has replaced good governance and those in Washington are only looking out for the good of their political party and not the good of the nation. Today, it is political party over country.
