Text Of President Ford's Pardon Proclamation

By the President of the United States of America a Proclamation
Richard Nixon became the thirty-seventh President of the United States on January 20, 1969 and was reelected in 1972 for a second term by the electors of forty-nine of the fifty states. His term in office continued until his resignation on August 9, 1974.

Pursuant to resolutions of the House of Representatives, its Committee on the Judiciary conducted an inquiry and investigation on the impeachment of the President extending over more than eight months. The hearings of the Committee and its deliberations, which received wide national publicity over television, radio, and in printed media, resulted in votes adverse to Richard Nixon on recommended Articles of Impeachment.

As a result of certain acts or omissions occurring before his resignation from the Office of President, Richard Nixon has become liable to possible indictment and trial for offenses against the United States. Whether or not he shall be so prosecuted depends on findings of the appropriate grand jury and on the discretion of the authorized prosecutor. Should an indictment ensue, the accused shall then be entitled to a fair trial by an impartial jury, as guaranteed to every individual by the Constitution.

It is believed that a trial of Richard Nixon, if it became necessary, could not fairly begin until a year or more has elapsed. In the meantime, the tranquility to which this nation has been restored by the events of recent weeks could be irreparably lost by the prospects of bringing to trial a former President of the United States. The prospects of such trial will cause prolonged and divisive debate over the propriety of exposing to further punishment and degradation a man who has already paid the unprecedented penalty of relinquishing the highest elective office of the United States.


Now, THEREFORE, I, GERALD R. FORD, President of the United States, pursuant to the pardon power conferred upon me by Article II, Section 2, of the Constitution, have granted and by these presents do grant a full, free, and absolute pardon unto Richard Nixon for all offenses against the United States which he, Richard Nixon, has committed or may have committed or taken part in during the period from January 20, 1969 through August 9, 1974.

IN WITNESS WHEREOF, I have hereunto set my hand this eighth day of September, in the year of our Lord nineteen hundred and seventy-four, and of the Independence of the United States of America the one hundred and ninety-ninth.

He hates her, he won't pardon her. Plus, she hasn't actually been charged with a crime. So, if he pardoned her, it'd be a pseudo admission of a crime.
 
Republicans have been investigating her since the capture of Egypt by the Persians in 525 BC, so if she was going to go to jail for anything it would have happened already. So no, Obama won't pardon her for any crimes that Republicans have been unable to to pin on her.

Read the Ford pardon of Nixon in the OP. There's admission of a crime, at all.
 
He can, as your reference to the Ford pardon of Nixon shows. But, I don't think he'll do it. I may very well be wrong.

If he pardon's her, it slams the door on any referrals to the DOJ for anything she may have done. I don't think it should stop the hearings in Congress, because we need to have lessons learned from events that occur and apply those to new legislation and regulations.

I'll say the same that I've said in all of these. No. The pardon would give the accusations more credibility and there is no danger of her actually being convicted of anything due to the partisan nature of our political atmosphere and her deep connections to it.

Question - With the R's controlling all 3 houses, do you think they will enact a law outlawing this - private email servers- using other means to prevent collection and retention of all emails- correspondence while in office?
IIRC they had control of 2 houses prior to the election and no law was sent to the President?

Any investigations of HRC would be a sideline and offer the R's the ability to state, we follow the law.
A pardon would remove that metric.
 
It is very possible. If he pardoned Manning he could likely pardon Clinton.

Conversely, any actions taking by Rs (justly or not) will be spun as a partisan attack and that they hate women and will ultimately be a losing proposition in the court of public opinion. Further, the Rs have a lot of things they want to do, that will be unpopular and will cost political capital, so I don't think this is a hill worth dying on.

Your point is made on having a good plan. Recall the comments during the election regarding HRC. Any investigation is looked upon as playing to their base.

That's a good question, however, there's already a number law that makes it illegal to take classified data outside of it's designated location, and laws that govern the maintenance and protection of government communications, which both would include not using a private server.

You see, that's why a lot of folks on the right are PO'ed about Hillary and her server. She broke a number of laws by doing that. And, nothing happened.

He's not going to pardon her because Trump has successfully been coy about not investigating her. It's clever of Trump to insist, over and over, that there's not going to be any charges. Most Trump supporters believe that part of the requirement to be TRUMP'S Attorney General was that they be willing to investigate Hillary.

It's not really a loophole, and the Congress doesn't enforce law, that's the job of the Executive Branch - which is another problem in itself, since Obama's Administration chose not to enforce the law and allow her to have a private server. I'm not an attorney, but I feel that there's more than enough laws in existence to cover this.

Clinton won't be pardoned, because Trump has no want to actually convict her.
