You can, but you were commenting on why no one else picked that one. It is because it doesn't make any sense for the SCOTUS to make such a ruling. They almost certainly wouldn't since it would later be challenged, pointing out that same sex couples were being unfairly penalized by some states who would make them refile for a marriage license in their state just for moving there or working their when opposite sex couples wouldn't have to do so. That would violate the 14th Amendment.
