If they had seen him, it would have been a different story. As it is, since they apparently did not, what law did he break? PS -- He didn't brandish his gun.

His name is Eric and he said in an interview, that day, that he drove there from Idaho to put up a "show of force" in support of Clive Bundy. He was aiming his weapon at Law Enforcement Officers.

That in itself is a criminal act.

He advised others to "get on a bridge"... presumably with a weapon as he did.
At the end of this interview he supported the idea that the Bundy people used children to protect them from being gassed.
If he had been seen by a law Enforcement Officer in his sniper pose he would have been immediately shot on the spot.
That is why he was cowering behind the knee wall.
