Some dads-to-be could be kept out of the delivery room in New Jersey. In a decision released this week, a judge ruled pregnant women can block the biological father of their children from entering the room.
"The ruling stems from the case of a couple who got engaged after the woman became pregnant, but later broke up. That father sued for the right to be present at the birth of the child, though a judge disagreed."That's according to Superior Court Judge Sohail Mohammed. The case started back in November when Steven Plotnick sued to get Rebecca DeLuccia to inform him when she went into labor. He wanted access to the baby when it was born.The two went to court the same day DeLuccia went into labor and gave birth to a baby girl. Mohammed ruled that day all patients, including pregnant women, can decide who can be at their hospital bedside. The decision was released on Monday.

Well he does not nor do i think he should.

Dont get me wrong, i see why and how this could be emotional and i understand how it can be perceived as mean or sad but the bottom line is its the women going through a medical issue. She gets to control the room and her privacy, if she doesnt want somebody in the room, even the father thats her right.

Yes and no. They have the right to be there if the mother of the child consents to them being there and the hospital allows them to be there. If they get in the way of the medical staff or cause some other type of problem that could effect the doctors ability to administer care or carry out the procedure, then the hospital should have the right to remove them from the area.

Now, when it comes to after the birth of the child.... I feel very differently about that!

If the mother consents, of course, I think the father should be present for support, and to share in the experience with her. I agree with you there.

However, I would add the caveat that you sometimes might very well need someone to, if not "get in the way" of medical staff, at least keep an eye on them and advocate for the mother's needs. There are some legitimately lazy and unscrupulous doctors out there who might try to take advantage of a laboring mother's distressed condition to force decisions upon her that may not necessarily be in line with her express medical wishes.

It can and does happen; unfortunately, more often than a lot of people in the medical field like to admit.

The judge made the right decision. It's the patients choice over who gets to be there along with the hospital rules.

and i agree with you

i have no idea how anybody comes to any other conclusion, i get the emotion but rights dont care about peoples feelings


in this situation nobody gets to see a womans privates against her will, how anybody could ever think otherwise is beyond me.
also if he just wanted to be in the corner of the room that also HER choice, she is exposed in there and going through medical situations, all her own business and privacy, he does NOT get to force himself in the room against his will.

It should be up to the mother. There are certain circumstances where its an invasion of privacy if the biological dad cold be there regardless of the mother's wishes.

- Pregnancy by rape is a big one. If I'm not mistaken most rape in America is never reported and most in cases the rapist a friend or acquaintance or the victim so in most such cases there would be no indication there should be any problem with the dad being present at birth while people with no understand of the true facts are allowed to make that choice.

- Couples who have separated or are estranged.

- Pregnancy as a result of cheating and the married couple is trying to reconcile despite a very difficult situation. Its sounds crazy but people aren't perfect and stuff happens. I have friends who handled conflict by both being unfaithful to each other during a difficult time in their marriage. They came to their senses, apologized to each other and reconciled. Then it was discovered the wife was preggers and the other guy was the biological father. The husband was the one by her side throughout the pregnancy and delivery. Having the biological dad in the delivery room by force would have only further complicated an already complicated situation. A wife might have secretly cheated and plans to tell her husband after the baby is born to allow for DNA testing. She might not think its right to have him in the delivery room knowing he might not be the father.

- Women who agree to be surrogate mothers either by artificial insemination or in vitro fertilization. In realize I'm probably more old fashioned than most but to me nobody should have the right to see down there unless the woman consents. In these cases, pregnancy did not occur the regular way so its not a case of he's already been there, done that, up close and personal so what's the fuss. Then add the distress of labor to the mix and its unfair to put a woman through that.

- Then you might have a normal healthy relationship but for whatever reason the mother doesn't what the father in the delivery room. Its silly to me but women invest a lot of their self-worth in appearance and body image. She might feel her husband won't be attracted to her any more if he gets grossed out. She might have some archaic attitude about childbirth being women's business and men shouldn't be around. He might smell bad and make her want to vomit at a time when she sense of smell is amplified. Who knows?

He doesn't have a right and I agree with that. He has (and should have) the right to be at the hospital and see the baby as soon as it's practical, but he doesn't have a right to be in the delivery room.

Why would a man even want to be in the delivery room if they are at odds with each other? I'm so glad I only have one baby's daddy and he's the only one I've ever wanted in the room. OT; I've seen those TLC shows where the womans own dad was in the room,all up in her canal. Shudder! That's just weird to me but to each his own, lol.

They should keep stripping men and fathers of rights. Maybe some of them will get a clue and not tie themselves down and slit their own throats.

The health aspect of it is my major issue. Childbirth can be dangerous, and even life threatening.

Adding the tension of an unwanted person to the room doesn't really accomplish anything but to make bad outcomes more likely.

If the father of the child being there is such an intense experience that it adversely affects the woman's procedure, that kid should just hope to be birthed stillborn. He's going to have a crappy life with a crappier mother.

If I was having an appendicitis attack and Hitler was 5 feet away, I'd never notice him.

It's really not a "procedure" though. It's a natural process, that simply happens to have the potential to turn into quite a few rather nasty "procedures" if something goes wrong.

As such, it is really in the best interests of the mother and baby alike that the woman be able to relax somewhat and concentrate so that she can be at the top of her game. Introducing persons that she might very well hate into the environment against her will isn't going to do anything to further that goal, and will actually detract from it.

And he will get to see it and have the right and obligation to be involved in it's life, but that doesn't mean that he has the right to be in the delivery room. It is a medical procedure and the mother does have a right to privacy.

The baby isn't a person. It's a possession.

It's not their baby. It's her baby.

It should always be the mother's right to not have people she doesn't want (as long as they aren't needed to help her and/or the baby) in the room while having a baby. Plus, the main purpose of allowing people in the room during a woman giving birth is to make her more comfortable and calmer, not because they have some right to see the child born. Seeing the child born is secondary. And if the presence counters the first/main purpose, then it does more harm than good.

He could stand by quietly in the delivery room with the mother's back to him, watch the birth without saying a word and then wait patiently to hold his child when brought to the nursery. That sounds very reasonable. I know the couple is estranged and not married. I hope the man insists on being a part of the child's life. It is going to need a good dad.

He cannot possibly watch the birth without seeing her private parts, and that would likely make her uncomfortable (more uncomfortable anyway). At least with the others in the room who are seeing her naked, they would being helping her and/or the baby. His purpose there would be purely for him, not her nor the baby.

Got that right. The child is already starting off life with a serious strike against him/her. Honestly, if anything the guy should take this as a harbinger that the woman isn't worth having in your life - and, by extension, the child.

In order to see the child coming out of her private parts, he is going to get a view of her private parts. Doesn't matter how he sees them.

He has no right to see them again, just because he's seen them before.

Well someone who wanted to be present at the birth and was willing to take it to court for the privilege, doesn't sound like someone who will abandon his child. But those child support payments will ensure he has every right to be a part of the child's life and the woman will just have to deal with it.
